Councilmembersoe-Pl— n;Neils, Schneider and Threinen Ine rollowing members were sent: none -tsar Cni,nri]member Moen introduced the following Resolution and moved its adoption: RESOLUTION NO. 82-379 APPROVING VARIANCES FROM THE SUBDIVISION CODE AND URBAN DEVELOPMENT POLICY RESOLUTION FOR HELEN RUSTEN TO PERMIT A PROPERTY DIVISION OF UNPLATTED PROPERTY LOCATED WEST OF QUEENSLAND LANE AND 8TH AVENUE NORTH (82030) WHEREAS, Helen Rusten has requested variances from the Subdivision Code and from the Urban Development Policy to allow division of unplatted property located in the unserviced area west of Queensland Lane and 8th Avenue North; and, WHEREAS, the Planning Commission has reviewed said request and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that It should and hereby does approve the variances from the Subdivision Code and Urban Development Policy for Helen Rusten to allow the division of unplatted property located west of Queensland Lane and 8th Avenue North as follows: EXISTING LEGAL DESCRIPTION P.I.N. No. 31-118-11-24-0001 To be divided into two parcels as follows: CERTIFICATE OF TITLE NO. 65406 That part of the West Half of Section Thirty-one (31), Township One Hundred Eighteen (118), Range Twenty-two (22) In Hennepin County, Minnesota, described as follows to -wit: Beginning at a point in the North li.ie of the Southeast Quarter of Northwest Quarter (SE1/4 NW1/4) of said Section Thirty-one (31), 240 feet west of the Northeast corner of said Southeast Quarter of Northwest Quarter (SEI/4 NW1/4) of said Section thirty-one (31); thence west on the North line of said Southeast Quarter of Northwest Quarter (SE1/4 NW1/4) of said Section Thirty-one (31), 1066.25 feet more or less to the Northwest corner of said Southeast Quarter of Northwest Quarter (SE1/4 NW1/4) of said Section Thirty-one (31); thence south along the West line of said Southeast Quarter of Northwest Quarter (SE1/4 NW1/4) of said Section Thirty-one (31), 300.9 feet; thence southeasterly along a line which if extended would intersect the North and South quarter section line of said Section Thirty-one (31) at a point 646.8 feet south of the center of said section to a point in said line which is 240 feet west measured at right angles of said North and South quarter section line; thence north parallel with the North and South quarter section line of said section, 1651.92 feet to the point of beginning, according to the qovernment survey thereof. Page 2 Resolution No. 82- 379 CERTIFICATE OF TITLE NO. 241339 The North 654.6 feet of the East 240 feet of the Southeast 1/4 of the North- west 1/4 of Section 31, Township 118, Range 22. Also that tract described as: Commencing at the Northwest corner of the Southwest 1/4 of the Northeast 1/4 of Section 31, Township 118, Range 22; thence Easterly along the North line of said Southwest 1/4 of the Northeast 1/4 256.4 feet; thence Southerly 652.8 feet to a point which is 241.67 feet East of the West line of said Southwest 1/4 of the Northeast 1/4; thence Westerly 241.67 feet to said West line of said Southwest 1/4 of the Northeast 1/4; thence Northerly along said line 654.6 feet to the point of beginning, according to the Government survey thereof. FURTHER, that the City Manager be authorized to make the necessary special assessment corrections based upon City Policy when the Division is approved by Hennepin County.
