The following members were present: _Mayor Davenpor , ouncilmembers"Mer—'T;s, The o ng memers were sent: none its sss introduced the following Resolution and moved its vpt on: RESOLUTION NO. 82- 378 APPROVING CONDITIONAL USE PERMIT FOR THE WAYZATA EVANGELICAL FREE CHURCH TO OPERATE A NURSERY SCHOOL FROM THE EXISTING CHURCH FACILITY LOCATED AT 705 NORTH HIGHWAY 101 ( 82032 ) WHEREAS, The Wayzata Evangelical Free Church has requested approval of a Conditional Use Permit to operate a nursery school in the church located at 705 North Highway 101; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of the Wayzata Evangelical Free Church to operate a nursery school in the church located at 705 North Highway 101 subject to the following conditions: 1. The permit is subject to all applicable codes, regulations and Ordinances and violation thereof shall be grounds for revocation. 2. The permit is issued to the petitioner/tenant as operator of the facility and shall not be transferable. 3. The site shall be maintained in a sanitary manner. 4. The permit shall be renewed in one (1) year to assure compliance with the conditions. 5. The nursery school operation shall be licensed by the State of Minnesota per State regulations and a copy of the current State license shall be kept on file with the City. Page two Resolution No. 82X78 6. Portable playground equipment shall be stored indoors durirq off -hours. 7. Any signs shall comply with Ordinance standards. The notion for adoption of the foregoing Resolution was duly seconded by ou cilmember Threinen , and upon vote being taken thereon, the . o ng voted n favor thereof: Mayor Davenport, Councilmembers Moen, Neils, Schneider and Threinen T following votedaga nst orabstained: none Whereupon the Resolution was declared duly passed and adopted.
