APPROVING AMENDMENT TO DEVELOPMENT CONTRACT FOR "OAKDALE WEST ADDITION" (79079)
WHEREAS, the City Council approved Final Plat and Development Contract for "Oakdale
West Addition" for Mr. Don Myron on March 2, 1981 under Resolution No. 81-146; and,
WHEREAS, item 14.5 of the Development Contract granted Lot width variances for Lots 2
and 3, Block 3; and;,
WHEREAS, item 14.6 provided that structures on Lots 2 and 3, Block 3 shall be setback
at a minimum, the distance from the front property line where the lots are 110 feet
` wide so as to comply with the width requirement in the Zoning Ordinance; and,
/ WHEREAS, item 14.4 provided that no building setback -variances are granted or implied
particularly for those lots approved with variances from Ordinance minimum width stan-
dards; and,
WHEREAS, the City Council has subsequently reviewed the impact of item 14.6 in further
detail with respect to the width variances granted under item item 14.5 and the
restriction on setback variances established under item 14.4;
NOW, THEREFORE, BE IT HERESY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve an amendment to the Development
Contract for "Oakdale West Addition" by deleting item 14.6, with the explicit reaffirm-
ation of item 14.4.
