Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 21st day of June 1982.

Councilmember Moen introduced the following Resolution and moved its
adopt on:
RESOLUTION NO. 82- 311
UPHOLDING RULING OF BOARD OF ZONING ADJUSTMENTS AND APPEALS IN THE MATTER OF WARD
KRUEGER FOR PROPERTY LOCATED AT 17210 19th AVENUE NORTH
WHEREAS, Mr. Ward Krueger of 2755 Holly Lane, Plymouth, Minnesota has requested
variances to permit a side yard setback of ten feet rather than fifteen feet on the
southwesterly property line and a sideyard of 12.4 feet rather than fifteen feet on the
northeasterly property line at Lot 2, Block 3, Oakdale West (17210 19th Avenue North),
for the purpose of locating a new dwelling closer to the front property line than that
directed by Council Resolution No. 80-454 and by he executed Development Contract for
this plat; and,
WHEREAS, the Board of Zoning Adjustments and Appeals heard the matter on May 10, 1982,
and ruled that the requested variances should be denied based upon the finding that no
grounds for variance were demonstrated in accordance with the Ordinance Variance
standards, and that the petitioner can construct the proposed building in keeping with
the City Council's direction and Ordinance standards; and,
WHEREAS, the petitioner in accordance with the City Zoning Ordinance has submitted
an appeal to the Board's finding in a letter dated May 12, 1982.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does uphold the rulinq of the Board of Zoninq
Adjustments and Appeals that the request of Mr. Ward Krueger for yard setback variances
on Lot 2, Block 3, Oakdale West Addition be denied.
The motion for adoption of the foregoing Resolution was duly seconded by
CoMpcilmember Threinen , and upon vote being taken thereon, the

Whereupon the Resolution was declared duly passed anif adopted.
