Pursuant to due call and notice thereof, a regular meeting of the City Council
of the City of Plymouth, Minnesota, was held on a 21st day of June ,
19 82 . The following members were present: Acting Mayor Schneider, Council-
mein�ers Moen Neils and Threinen
The following members were absent: Mayor Davenport
Councilmember Moen introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 82-307
AUTHORIZING AND DIRECTING THE BASSETT CREEK FLOOD CONTRO! COMMISSION TO PREPARE AN
AMENDED JOINT POWERS AGREEMENT AND A PLAN TO REORGANIZE THE COMMISSION TO COMPLY
WITH SURFACE WATER MANAGEMENT LEGISLATION ADOPTED BY THE 1982 MINNESOTA LEGISLATURE
WHEREAS, the Minnesota Legislature has adopted S. F. 1451 which was signed into
law by the governor on March 22, 1982, and
WHEREAS, the watershed management organization has responsibilities under said act
to proceed in areas not currently authorized by the joint powers agreement creating
the Bassett Creek Flood Control Commission, and
WHEREAS, it is necessary that a watershed management orqanization with proper powers
be in existence by December 31, 1983 or the responsibility for surface water manage-
ment will be transferred to the County who will then create a watershed district to
manage the watershed, and
WHEREAS, the Bassett Creek Flood Control Commission has been a mint and cooperative
effort of this city along with eight other cities for the past 14 years and the
Bassett Creek Flood Control Commission has ordered improvements and prepared plans
for management, and
WHEREAS, this city along with the other cities has a substantial investment in the
commission and in the plans prepared and adopted for managment of surface water,and
WHEREAS, the city has had a good working relationship with the Bassett Creek Flood
Control Commission and believes it is in the public interest to continue that com-
mission;
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Plymouth as follows:
1. The Bassett Creek Flood Control Commission is authorized and en-
couraged to prepare an amended joint powers ageeement to bring
it into conformance with M.S. Section 473.877 as a watershed
management organization. Upon completion of the proposed amend-
ed agreement to this council for our further consideration.

2. In the preparation of the amended agreement the Bassett Creek
Flood .Control Commission is authorized to structure itself in
such a manner that it can prepare the watershed plan required
by the act.
3. The city manager and the city engineer are authorized and
directed to cooperate with the Bassett Creek Flood Control
Commission in the preparation of an amended joint powers agree-
ment and to prepare a plan which will bring this city into
conformance with the mandated requirements of the new act re-
lating to surface water management and they are further directed
to keep this council advised as the planning proceeds.
