Councilmember Schneider Introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 82-274
ADOPTING ASSESSMENTS
PROJECT NO. 228
WH"REAS, the City received a Waiver of Assessment Hearing from John B. Daily and
Marily M. Daily, owners of that part of Lot 1, Block 10, Elmhurst, according to
the reorded plat thereof, Hennepin County, Minnesota, lying south of a line
drawn from a point on the west line of said Lot 1 distant 80.00 feet north of
the southwest corner of said Lot 1 to a point on the east line of said Lot 1
distant 111.66 feet north of the southeast corner of said Lot 1 as measured
along the easterly line of said Lot 1 for Installation of sanitary sewer lateral
and sanitary sewer trunk facilities:
' NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a part
hereof, is hereby accept El and shall constitute the special assessment
against the lands named therein and each tract of land therein included is
hereby found to be benefited by the proposed improvement in the amount of
the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over
a period of 10 years, the first of the installments to be payable on or
beforethefirst Monday in January, 1983, and shall bear interest at the
rate of 10.54% per annum from the date of the adoption of this assessment
resolution. To the first installment shall be added interest on the entire
assessment from the date of this Resolution until December 31, 1983. To
each subsequent installment when due shall be added interest for one year on
all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certifica-
tion of the assessment to the County Finance Director, pay the whole of the
assessment on such property with interest accrued to the date of payment to
the City Treasurer, except that no interest shall be charged if the entire
assessment is paid within thirty days from the adoption of this resolution;
andhemay, at any time thereafter, pay to the City Finance Director the
entire amount of the assessment remaining unpaid with interest accrued to
