moved its adoption:
RESOLUTION NO. 82- 252
AUTHORIZING THE VACATION OF
A PORTION OF 26TH AVE. FRONTAGE ROAD ADJACENT TO NORTHWEST BUSINESS CAMPUS ADDITION
WHEREAS, a petition was received to vacate a portion of 26th Ave. frontage road
adjacent to Northwest Businees Campus Addition; and
WHEREAS, a public hearing with respect to said vacation was held on January 18,,
1982 in accordance with Minnesota Statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of January 18, 1982; and
WHEREAS, the Council did hold a public hearing on January 18, 1982 to inform any
and all interested parties relevant to the vacation of a portion of 26th Ave.
frontage road adjacent to Northwest Business Campus Addition; and
WHEREAS, it was determined by the City Council that a certain portion of 26th Ave.
frontage road adjacent to Northwest Business Campus Addition is not needed for a
public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That the following portion of 26th Ave. in the Northwest Business Campus
Addition be vacated as public roadway:
That part of 26th Avenue firth located within Outlot H, Northwest Business
Campus described as follows:
That part of the South 33.00 feet of the South Half of the Southeast Quarter
of Section 22, Township 118, Range 22, Hennepin County, Minnesota lying
easterly of State Highway No. 55 and westerly of the Creek.
2. That the following portion of 26th Ave. frontage road adjacent to Northwest
Business Campus Addition be vacated as public roadway:
That part of Tracts A and B described below:
Tract A. That part of the South Half of the Southeast Quarter of Section 22,
Township 118 North, Range 22 West, Hennepin County, Minnesota, lying west of
the creek and easterly of County Road No. 24;
Tract B. That portion of the following described property lying north of
the center line of State Trunk Highway No. 55;

That part of the Southwest Quarter of the Southeast Quarter
of Section 22, Township 118 North, Range 22 West, Hennepin
County, Hinaesota,.described as: Beginning at the southwest
corner of said quarter quarter; thence north along the west
line thereof to a point 41.1 feet north of the intersection
of said west line with the northeasterly right of way line
of State Trunk Highway No. 55; thence deflecting to the
right 96 degrees 23 minutes 00 seconds a distance of 57.03
feet; thence deflecting to the right 23 degrees 51 minutes
00 seconds a distance of 134.9 feet; thence deflecting to
the right 24 degrees 24 minutes 00 second a distance of
49.65 feet; thence southerly 48.8 feet, more or less, to a
point on the northeasterly right of way line of said
highway, distant 241.12 feet southeasterly along said
northeasterly right of way line from the west line of said
quarter quarter; thence southerly to a point on the
southwesterly right of way line of said highway, distant
280.36 feet southeasterly along said southwesterly right of
way line from the west line of said quarter quarter; thence
southerly 107.34 feet, more or less, to a point on the south
line of said quarter quarter, distant 246.18 feet east along
said south line from the point of beginning; thence west
246.18 feet to the point of beginning, according to the
Government Survey thereof, the title 'thereto being
registered as evidenced by Certificate of Title No. 401028;
which lies northeasterly of Line A described below and southwesterly
of Line B described below
EXCEPT the portion of said tracts described as follows: '
Commencing at the southwest corner of said Southeast Quarter; thence on an
assumed nearing of North, along the west line of said Southeast Quarter to
the intersection with Line A (which line is described below); thence South
51 degrees 02 minutes 35 seconds East along said Line A, a distance of
120.80 feet to the point of beginning; thence northeasterly 72.53 feet
along a tangential curve, concave to the northwest, having a radius of
44.74 feet and a central angle of 92 oegrees 53 minutes 25 seconds; thence
North 36 degrees 04 minutes East, tangent to last described curve, 59.50
feet to the intersection with Line B (which line is described below);
thence South 52 degrees 26 minutes 30 seconds East, along said Line B a
distance of 96.44 feet to an angle point in said Line B; thence South 59
degrees 34 minutes 00 seconds East along said Line B a distance of 33.21
feet; thence southeasterly 140.39 feet along a nontangential curve, concave
to the northeast, having a radius of 95.00 feet and a central angle of 84
degrees 40 minutes 15 seconds and the chord of said curve bears South 14
degrees 05 minutes 53 seconds East; thence South 56 degrees 26 minutes
East, tangent to last described curve, 69.19 feet to the intersection with
said Line A; thence northwesterly along said Line A to the point of
beginning.

Lines A and 8 are described as follows:
Line A
From a point on Line C described below, distant 100 feet southeasterly of
its point of beginning, run northeasterly at right angles to said Line C
for 150 feet to the point of beginning of Line A to be described; thence
run southeasterly to a point distant 120 feet northeasterly (measured at
right angles) of a point on said Line C, distant 300 feet southeasterly of
its point of beginning; thence run southeasterly parallel with said Line C
to an intersection with the south line of said Section 22 and there
terminating.

Beginning at a point on the north and south quarter line of said Section
22, distant 700 feet north of the south quarter corner thereof; thence run
easterly at right angles to said north and south quarter line for 50 feet;
thence run soutneasterly to a point which is 240 feet northeasterly
(measured at right angles) of a point on Line C described below, distant
13.5 feet northwesterly of the north and south quarter line of said Section
22; thence run southeasterly to a point which is 215 feet northeasterly
(measured at right angles) of a point on said Line C, distant 186.5 feet
southeasterly of the north and south quarter line of said Section 22;
tnence run southeasterly parallel with said Line C to an intersection with
the south line of said Section 22, and there terminating;
Line C
From a point on the north and south quarter line of said Section 22,
distant 334 feet north of the south quarter corner thereof, run
nortriwesterly at an angle of 59 degrees 34 minutes 00 seconds from said
north and south quarter line (measured from north to west) for 213.5 feet
to the point of beginning of Line C to be described; thence run
southeasterly on the last described course for 1400 feet and there
terminating.
3. That said vacation shall not affect the authority of any person, corporation, or
municipality owning or controlling electric or telephone poles and lines, gas and
sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue
maintaining the same or to enter upon such way or portion thereof vacated to repair,
replace, remove or otherwise attend thereto.
4. That the Mayor and City Manager are authorized to execute a quit claim deed conveying
the City's interest in the vacated right-of-way to Prudential Insurance Company of
America.
The motion for the adoption of the foregoing Resolution was duly seconded
by Cnunrilmpmhpr Mnpn , and upon vote being taken thereon, the
following voted in favor thereof: flavor Davenport. Councilmembers Moen,
Nails_ Srhneidpr and Thrpinpn
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
