HomeMy WebLinkAboutCity Council Resolution 1982-214rnimrilmember Moen introduced the following Resolution and moved its adoptions RESOLUTION NO. 82-214 DENIAL OF REQUEST BY HALLEY LAND CORPORATION FOR AN RPUD CONCEPT PLAN FOR A SEVENTY-EIGHT ACRE SITE (82001) WHEREAS, Halley Land Corporation has requested approval of an RPUD Concept Plan for a 78 acre site located east of I-494 and north of Soo Line Railroad tracks In Section 3; and, WHEREAS, the Planning Commission has reviewed the matter at a duly called Public Hearing; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that It should and hereby does deny the request by Halley Land Corporation for an RPUD Concept Plan for a seventy-eight acre site located east of I-494 and north of the Soo Line Railroad tracks in Section 3 for the following reasons! 1. That the urban utilities and streets are unavailable at this time and are not included in the Capital Improvements Program to service this property. 2. Per the Zoninq Ordinance the subject property cannot be rezoned until urban services are available and PUD's are allowed as a conditional use In Urban Zoning Districts. 3. Because the services are not available an application at this time Is premature. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Threinen , and upon rote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils, Schneider and Threinen The following voted against or stained: none Whereupon the Resolution was declared duly passed and adopted.
