Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 19th day of
April , 1982. The following members were present: Mayor Davenport,
Councilmembers Moen, Schneider and Threinen . The following members were
absent: Councilmember Hoyt
Councilmember Schneider introduced the following Resolution and moved its
adoption:

ADOPTING ASSESSMENTS
PROSECT 228
WHEREAS, the City received a Waiver of .Assessment Hearinq from the property
owner of that part of Lot 1, Block 10, Elmhurst, accordinq to the recorded plat
thereof, Hennepin County, Minnesota, lyinq north of a line drawn from a point on
the west line of said Lot 1 distant 80.00 feet north of the southwest corner of
said Lot 1 to a point on the east line of said Lot 1 distant 111.66 feet north
of the southeast corner of said Lot 1 as measured along the easterly line of
said Lot 1, waiving their right to a special assessment hearina coverinq the
Installation of sanitary sewer lateral and sanitary sewer trunk facilities:
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a
hereof, is hereby accepted and shall constitute the special assessment
against the lands named therein dnd each tract of Land therein Included
hereby bound to be benefited by the proposed Improvement in the amount
the assessment levied against it.

2. Such assessment shall be payable in equal annual installments expendinq over
a period of 10 years, the first of the installments to be payable on or
before the first Monday in January 1993 and shall bear Interest at the rate
of 10.54% per annum from the date of adoption of this assessment
resolution. To the first installment shall be added interest on the entire
assessment from the date of this resolution until December 31, 1983. To
each subsequent installment, when due shall'be added Interest of one year on
all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certifica-
tion of the assessment to the County Finance Director, pay the whole of the
assessment on such property with interest accrued to the date of payment to
the City Treasurer, except that no interest shall be charged if the entire
assessment is paid within thirty days from the adoption of this resolution;
and he may, at any time thereafter, Day to the City Finance Director the
entire amount of the assessment remaininq unpaid with interest accrued to
December 31 of the veer in which the payment Is made.
4. The Clerk shall forthwith transmit a certified duplicate of this assessment
to the County Finance Director to be expended on the proper tax lists of the
County and such assessments shall he collected and paid over in the same
manner as other municipal taxes.

5. The total cost of the improvement assessed by this resolution is $2,113.19
The motion for the adoption of the foregoing Resolution was duly seconded by
ppuncilme er Moen . and upon vote being taken thereon, the
ollowing voted reof: Mayor Davenport, Councilmembers Moen, Schneider
and Throinan
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and opted.
