HomeMy WebLinkAboutCity Council Resolution 1982-188CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 7th day of April . 1982, The following members were present: Mayor Davenpor ouncilmemberso—PI en, Sch eider FAPuj Thrai nan The following members were absent: Councilmember Hoyt ftp ;t• tff rnlinrilmamhar Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 82 - i88 APPROVING REVISION TO MPUD 78-2 FINAL PLAN AND SETTING CONDITIONS TO BE MET PRIOR TO FILING LOT DIVISION FOR FRANK LARSEN, PLYMOUTH HILLS COMPANY FOR "PLYMOUTH HILLS 3RD ADDITION" (82006) WHEREAS, Frank Larsen has requested a revision to the Final Plan for MPUD 78-2 relative to uses in "Plymouth Hills 3rd Addition; and, WHEREAS, the City Council has approved a Lot Division for Lot 1, Block 1, "Plymouth Hills 3rd Addition", the southeast quadrant of Vicksburg Lane and County Road 9; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, 10 MINNESOTA, that it should and hereby does approve the revision of the Final Plan for MPUD 78-2 and direct the following conditions related to that revision and to be met prior to filing of said Lot Division with Hennepin County: 1. City Council approval of a Site Plan (and any Conditional Use Permit) and application for Buildinq Permit prior to filing of the Lot Division. 2. No building permits to be.issued until the Lot Division is filed and recorded with Hennepin County. 3. Compliance with appli. .ale conditions of the executed Development Contracts for "Plymoui Hills Addition", "Plymouth Hills 2nd Addition", and, "Plymouth Hills aid Addition". 4. All dead or diseased trees shall be removed from the property at the owner's expense. 5. There shall be no private curb -cut access onto Vicksburg Lane and County Road 9. 6. Yard setbacks shall be per Zoning Ordinance; specifically, front yard setbacks along new County Road 9 and Vicksburg Lane shall be no less than 75 feet, and shall be developed with substantial berminq. 7. Submittal of required utility and drainage easements as approved by the City Engineer. Page 2 Resolution No. 82-188 S. Submittal of perpetual cross -easements for access and shared roadway facilities in recordable form to be reviewed and approved by the City Attorney prior to filing of the Lot Division. 9. Compliance with Engineer's Memorandum except for the requirement that a "looped private street be provided ;or cccess"(Item No. 22 9). 10. Access will be a private street at the south end of the lot, but not extending into Vicksburg Lane. 11. Provision for a cross easement on the north of this site to connect with the adjacent easterly site for possible future interconnection of driveways and/or parking lots. 12. The executed Development Contract for "Plymouth Hills 3rd Addition" shall be amended to provide for the extension of sanitary sewer to the new parcel. 13. The executed development contract for Plymouth Hills 3rd Addition shall be amended to provide for the construction of the approved access road, based on public street design standards with a cul-de-sac at the west end; consistent with the road design approved for the revised MPUD plan • for the 3rd Addition. The motion for adoption of the foregoing Resolution was duly !seconded by Councilmember Moen , and upon vote bekng taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Schneider and Threinen the following voted against or abstained: none ■hereupon the Resolution was declared duly passed and adopted.
