Pursuant to due call and notice thereof, a regular meeting of the City Council
of the City of Plymouth, Minnesota, was held on t e 1st day of March ,
19 82 . The following members were present: Mayor Davenport, Councilmembers

The following members were absent: none

Councilmember Threinen introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 82-133
RESOLUTION ESTABLISHING JUST COMPENSATION AND
AUTHORIZING OFFERS TO ACQUIRE ACQUISITION PARCEL
WHEREAS, the City of Plymouth is carrying out a Community Development Block
Grant project known as Senior Citizen Housing Project, which includes the
acquisition of real property; and
WHEREAS, the City of Plymouth has had the parcel of real property to be
acquired appraised for its fair market value by two qualified independent
professional real estate appraisers, who have completed written reports
documenting said values; and
WHEREAS, another qualified appraiser has reviewed these appraisal reports,

a personal on-site inspection of these properties, and has on file a
written report setting forth his opinion as to fair market value; and
WHEREAS, the work of the appraisers and review appraiser with respect to
each property has been performed in a competent manner in accordance with
applicable State law, the Uniform Relocation Assistance and Real Property
Acquisition Act and Department of Housing and Urban Development policies
and requirements;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA as follows:
1. That said opinions of fair market value in writing by the
qualified review appraiser are certified to be accurate and
correct and the fair market value is hereby adopted by the
City Council of the City of Plymouth as just compensation;
and
2. That the fair market value for the subject property, the
property itself, and the interest to be acquired are delineated
and identified in the staff report dated February 26, 1982
and kept on record in the files of the City of Plymouth; and

3. That the City of Plymouth's staff and its attorneys are hereby
authorized to acquire the subject properties by direct purchase
or donation for amounts not to exceed those certified herein
as just compensa+ion; and
4. That if the City of Plymouth staff and its attorneys are unable
to acquire any of the subject property by direct purchase or
donation for the amounts of just compensation, the City of Plyuth
will either authorize payment in excess of fair market value
or the institution of eminent domain proceedings to complete the
acquisitions.
The motion for the adoption of the foregoing Resolution was duly seconded
by Co ncilmember Hoyt , and upon vote being taken thereon, the
fol owing VOted 1n favor thereof: Mayor Davenport, Councilmembers Hoyt,
Moan, Schneider and Threinen

Whereupon the Resolution was declared duly passed and adopted.
