HomeMy WebLinkAboutCity Council Resolution 1982-131CITY OF PLYMOU1H Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held the 1st day of March , 19 82. The following members were present: ayor �"avenport, Counci mem ers Hoyt, Moen, Schneider -and Threinen The following members were sent: none •�� aa* ��* �puncilmember Hoyt introduced the following Resolution and moved its option: RESOLUTION NO. 82- 131 AUTHORIZING CONDEMNATION PROCEEDINGS PROJECT NO. 901 NORTH CENTRAL SEWER INTERCEPTOR WHEREAS, the City has undertaken Project No. 901; and WHEREAS, in order to construct the improvements certain permanent and temporary easements are required; and WHEREAS, the City Council finds it necessary, proper and expedient in the interest of public health, convenience and general welfare of the citizens of the City of Plymouth for the City to acquire said easements; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, 10 MINNESOTA that the City Attorney is hereby authorized to commence condemnation proceedings for Project No. 901 for the following described easements over the following described parcels: PARCEL 1: That part of the East half of the Southwest quarter of Section 14, Township 118, Range 22, Hennepin County, Minnesota described as beginning at the Northeast corner of said East half; thence South along the East line of said East half to the North line of Outlot A, Mission Ridge 2nd Addition; thence West along said North line to the Northwest corner of the Westerly portion of Outlot A; thence North along the extension of the most Westerly line of Outlot A, to a point 650 feet North from the South line of the Southwest quarter of Section 14; thence West at right angles with the East line of said East 1/2 a distance of 100 feet; thence Northwesterly to a point on the North line of the Southeast quarter of the Southwest quarter a distance of 600 feet West of the Northeast corner thereof; thence North parallel with the East line of said East 1/2 to the South line of the North 1200 feet of said East 1/2; thence West along said South line to a point 300 feet East from the West line of said East 1/2; thence North 600 feet parallel with the West line of said East 1/2; thence East 180 feet parallel with the North line of said East 1/2; thence North parallel with the West line of said East 1/2 to the North line thereof; thence East to the point of beginning, except road. , Description of Easements: A perpetual easement 20 feet in width for sanitary sewer purposes and a temporary construction easement 100 feet in width over, under and across the East 200 feet of the West 500 feet of the South 600 feet of the North 1200 feet of the Northeast quarter of the Southwest quarter of SEction 14, Township 118, Range 22, Hennepin County, Minnesota. The common centerline of said easements being described as beginning at Resolution No. 82-131 Page 2 10 Description of Parcel 1 Easement continued: a point on the West line of said East 200 feet distant 939.74 feet South from the North line of said Northeast quarter of Southwest quarter; thence Easterly to a point in the East line of said West 500 feet distant 945.73 feet South from the North line of said Northeast quarter of Southwest quarter and there terminating. PARCEL 2: That part of the Northeast quarter of the Southeast quarter of Section 15, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Commencing at the intersection of the centerline of County State Aid Highway No. 9 with the West line of said Northeast quarter of Southeast quarter; thence South along said West line 495 feet; thence East to the centerline of West Medicine Lake Drive; thence North- westerly along said centerline to the centerline of said Highway No. 9; thence Southwesterly along said centerline to the point of beginning. Description of Easements: A permanent easement for street and utility purposes over, under, across and through that part of the above described parcel which lies West of West Medicine Lake Drive and East of a line drawn 50 feet West of and parallel with the following described line: Commencing at the Northwest corner of said Northeast quarter of Southeast quarter of Section 15; thence on an assumed bearing of North 89 degrees 37 minutes 10 seconds East along the North line thereof 340.79 feet; thence South 22 degrees 21 minutes 12 seconds East 265.56 feet to the point of beginning of the line to be described; thence Southerly 396.19 feet along a tangential curve concave to the West having a central angle of 7 degrees 55 minutes 26 seconds and a radius of 2864.79 feet; thence South 14 degrees 25 minutes 46 seconds East and tangent to said curve 509.18 feet and there terminating. And A 20 foot temporary construction easement over, under and across the above described property. The West line of said temporary construction easement being 70 feet West of and parallel with the above described line. The motion for the adoption of the foregoing Resolution was duly seconded byCouncilmember Threinen , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Hoyt, Moen Schneider and Threinen The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
