The following members were Maor Davenporty, Councilmembers Hoyt Moen Schneider and Threinen The following members were a sent. none Cgupcilmember Hoyt introduced the following Resolution and moved its adoption: RESOLUTION NO. 82-129 AUTHORIZING CONDEMNATION PROCEEDINGS PROJECT NO. 204 GLACIER LANE - 27TH AVE. TO 28TH PLACE WHEREAS, the City has undertaken Project No. 204; and WHEREAS, in order to construct the improvements certain permanent and temporary easements are required; and WHEREAS, the City Council finds it necessary, proper and expedient in the interest of the public health, convenience and general welfare of of the citizens of the City of Plymouth for the City to acquire said easements; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the City Attorney is hereby authorized to commence condemnation • proceedings for Project No. 204 for the following described easements over the following described parcel: Parcel 1. DESCRIPTION OF PARCEL: The South 2 acres of the East 4 acres of the South 20 rods of the North 40 rods of the Southeast quarter of the Southeast quarter of Section 21, Township 118, Range 22, Hennepin County, Minnesota, except roads described as follows: The West 50 feet and that part of the above described parcel lying East of the following described line: Commencing from the intersection of the centerline of Fernbrook Lane with the Easterly extension of the South property line; thence West along said South property line a distance of 60 feet to the actual point of beginning of the line to be described; thence North parallel to the centerline of Fernbrook Lane a distance of 95 feet more or less to the point of intersection with the North property line and there terminating. And A temporary easement for construction purposes over and across the East 10 feet of the West 60 feet of the above described parcel. Said temporary easement will terminate on December 31, 1983 or upon completion of construction, whichever occurs first. Parcel 2. Said temporary easement will terminate on December 31, 1983 or upon completion of construction, whichever occurs first. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Threinen , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Hoyt, Moen, Schneider and Threinen The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
