Pursuant to due call and notice thereof, a special meetino of
the City Council of the City of Plymouth. Minnesota was he d on the
22nd day of February 1982 . The following members were
present: Mayor Davenport, Councilmembers Hoyt, Moen, Schneider and Threinen .
The following members were absent: none

C uncilmember Hoyt introduced the following Resolution and
moved its s adoption:
RESOLUTION N0, 82-100
REQUEST FOR PAYMENT NO. 8 AND FINAL
PUMP HOUSE NO. 5
PROJECT NO. 812
WHEREAS, the City of Plymouth as owner and A & K construction Co. as contractor
have entered into an agreement for the improvement of Pumhouse No. 5, said
agreement being dated May 8, 1979; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount was $77,889.00, two change orders
in the amount of $4,907.65 were approved, and the value of the work
completed and certified to date is $82,796.65.
2. That the work performed by the contractor for Project No. 812 and
certified to the Council by the engineer as acceptable be and the
same is hereby released from the contract except as to the conditions
of the performance bond, any and all legal rights of the owner,
required guarantees and corrections of faulty work after final payment.
3. Request for Payment No. 8 and Final in the amount of $6,236.44 to
A & K Construction Co. for Project No. 812 is hereby apprnved and
the City Finance Director is hereby authorized and directed to pay
the same forthwith.
4. That Resolution No. 81-488 which previously accepted the work is
rescinded.
The motion for the adoption of the foregoing Resolution was duly seconded by

following voted in fher: Mayor Davenport, Councilmembers Hoyt,
Moen, Schneider and Threinen

Whereupon the Resolution was declared duly passecf and adopted.
