Pursuant bo due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota was held on the 22nd day of
February . 1982. "e following meabers were present:'Rayor Davenport,
Councilmembers Hot Moen Schneider and Threinea The following manners were
absent: none
Councilmember Schneider introduced the following Resolution and mored its
adoptim:

ADOPTING ':ESOLUTION
SANITARY SEWER AND WATER k' 'A - AMHURSP THIRD ADDITION

WHEREAS, in conformance with the development contract we have received a waiver
of assessment hearing from the property owner of Amhurst Third Addition waiving
their right to special assessment hearings covering the installation of sanitary
sewer trunk facilities and water trunk facilities and all other appurtenances;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. Such proposed assessment, a copy -6f which is attached hereto and made a
hereof, is hereby accepted and shall constitute the special assessment
against the lands named therein and each tract of land therein included
hereby bound to be benefited by the proposed improvement in the amount

2. Such assessment shall be payable in equal annual installments expending over
a period of 5 years, the first of the installments to be payable an or
before the first Monday in January 1983 and shall bear interest at the rate
of 10.54% per annum from the date of adoption of this assessment
resolution. Th the first installment shall be added interest on the entire
assessment from the date of this resolution until December 31, 1983. Th
each subsequent installment, when due shall be added interest of one year on
all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certifica-
tion of the assessment to the County Finance Director, pay the whole of the
assessment on such property with interest accrued to the date of payment to
the City Treasurer, except that no interest shall be charged if the entire
assessment is paid within thirty days from the adoption of this resolution;
and he may, at any time thereafter, pay to the City Finance Director the
entire amount of the assessment remaining unpaid with interest accrued to
December 31 of the year in which the payment is made.
4. The Clerk shall forthwith transmit a certified duplicate of this assessment
to the County Finance Director to be eytended on the proper tax lists of the
County and such assessments shall be collected and paid over in the same
manner as other municipal taxes.
5. The total cost of the improvement assessed by this resolution is $10,260.00.
The motion for the adoptian of the foregoing Resolution was duly seconded by
Courcilmember Threinen , and upon vote being taken thereon, the
following voted in favor thereof: _Mayor Davenport, Councilmembers Hoyt, Moen,
Schneider and Threinen
