Pursuant bo duce call and notice thereof, a special meeting of the City Qouncil of
the City of Plymouth, Minnesota, was held on the 22nd day of February . 1982.
The following members were present: Mayor Davenport, uncilmembers Moen, Schneider
ā_ and Threi nen
The following members were absent: Councilmember Hoyt `
CoWncilmember Schneider introduced the following Resolution and moved its
adoption:
RESOLUTION N0. 82- 74
APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR A "DAY CARE CENTER" LOCATED
NORTHEAST OF NATHAN LANE AND BETTY CROCKER DRIVE. (80053)
WHEREAS, Wallace Freeman has requested approval of a Site Plan and Conditional Use
Permit for a "Day Care Center" to be located northeast of Nathan Lane and Betty
Crocker Drive; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends its approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED F"t THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the request of Wallace Freeman for
Site Plan approval and Conditional Use Permit approval for a "Day Care Center" to be
10located northeast of Nathan Lane and Betty Crocker Drive subject to the following
conditions:
1. Compliance with the Engineer's Memorandum.
2. Any signage shall conform with the City Ordinance Standards.
3. The permit is subject to all applicable codes, regulations, and ordinances,
and violation thereof shall be grounds for revocation.
4. All portable playground equipment and materials shall be stored inside when
not in use; and, the playground area shall be maintained in a clean and
sanitary manner.
5. The fenced play area shall be secured during non -school hours to inhibit
unauthorized access and use of any permanent equipment.
6. A copy of the current State License shall be kept on file at the City.
7. The permit shall be reviewed annually to assure compliance with the con-
ditions.
8. The Conditional Use Permit is issued to "New Horizon Day Care Center" as op-
erator of the facility and shall not be transferable.
9. Payment of Park Dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of building permit issuance.

10. All waste, and waste containers shall be stored within the approved storage
area.
11. Submission of required financial guarantees for completion of the site im-
provements termed for 24 -months.
12. Appropriate legal documents to be submitted for review and approval by the
City Attorney providing for shared access and parking facilities.
13. Fire lane signage shall be installed per the Fire Marshal's recommendation
prior to occupancy of the "Clay Care Center".
14. Building shall be sprinklered per Ordinance No. 81.25.
