HomeMy WebLinkAboutCity Council Resolution 1982-067CITY of PLYNOM Pursuant to due call and notice thereof, a special meeting of the City Oouncil of Whe City of Plymouth, Minnesota, was held on n�22nd day of February . 19 82 he following members were Present: Mayor Davenport, Councilmembers Hoyt, Moen, a�w�`�nd T rei nen e following members were t: none Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 82- 67 APPROVING REVISED RPUD PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT FOR "PLYMOUTH HILLS 4TH ADDITION" (81073) WHEREAS, Frank Larsen, Plymouth Hills Company, has requested approval of a Revised RPUD Preliminary Plan/Plat and Conditional Use Permit for outlot E of the "Plymouth Hills Revised" plat located northeast of Plymouth Bouelvard and 37th Avenue North; and, WHEREAS, the Planning Commission has considered the request following a duly called Public Hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve a Revised RPUD Preliminary iPlan/Plat and Conditional Use Permit -3r property located northeast of Plymouth Boulevard and 37th Avenue North subject to the following conditions: 1. Compliance with the Engineer's Memorandun. 2. The Final Plat/Plan include provisions for the sidewalks per the Master Sidewalk Plan; a bus pull -over adjacent to the proposed elderly housing site; and an intersite pedestrian circulation plan offering access to the trail corridor. 3. Removal of all dead or dying trees from the property at the owner's expense. 4. Rezoning shall be finalized with filing of the Final Plat. 5. Payment of Park Dedication fees -in -lieu of dedication in accordance with the Dedicaion Policy in effect at the time of filing the Final Plat. 6. Compliance with City Council Policy Resolution No. 78-80 regarding minimum floor elevations for new structures in subdivisions or on sites adjacent to, or containing any open storm water drainage facilities. 7. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County. 8. Compliance with Section 9 of the Zoning Ordinance regarding the filing of covenants and other documents governing control and maintenance of common areas, including utility and trail easements. Construction of the public trail improvements including construction of a bridge in accordance with City standards shall be completed concurrently with deve.loprent of adjacent sites. 10. Maximum density for the entire PUD shall not exceed the Comprehensive Plan LA -4 maximum density of 20 units per acre, 11. Final Plat shall be modified to eliminate the separation of the northerly site and the southeasterly site; access to the public trail corrider (from the southwesterly elderly site) shall be provided by private easement along the common lot line.
