Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 1st day of
February 19 82The following members were present:

Councilmember Moen introduced the following Resolution and moved

RESOLUTION NO. 82-57
AUTHORIZING CONDEMNATION PROCEEDINGS
PROJECT 024
HIGHWAY 55/COUNTY ROAD 15 INTERSECTION IMPROVEMENT
WHEREAS, the City and the State of Minnesota have undertaken Project No. 024,
Highway 55/County Road 15 Intersection Improvement, which includes streets and
utilities; and
WHEREAS, in order to construct the improvements certain permanent and temporary
easements are required; and
WHEREAS, the City Council finds it necessary, proper and expedient in the interest
of the public health, convenience and general welfare of the citizens of the City
of Plymouth fer the City to acquire said easements;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the City Attorney is I_reby authorized to commence condemnation
proceedings for Project No. 024 for the following described easements over the
following described parcels:
1. PARCEL ONE
That part of Tract A described below:
Tract A. That part of the Northeast Quarter of the Southwest Quarter of Section 36,
Townshirp 118 North, Range 22 West, Hennepin County, Minnesota, lying northeasterly of the
center line of Trunk Highway No. 55 as now located and established; excepting therefrom
that part of said Northeast Quarter of the Southwest Quarter lying southerly of the
center line of County Road No. 6 as shown on the plat of Ivanhoe Woods; the title thereto
being registered as evidenced by Certificate of Title No. 488147;
which lies northerly of the northeasterly right of way line of said Trunk Highway No. 55
and southerly of Line 1 described below:
Line 1. Beginning at a point on Line 2 described below, distant 398.8 feet southeasterly
of its point of termination; thence run northeasterly at right angles to said Line 2 for
240 feet; thence run easterly to a point distant 275 feet northeasterly (measured at right
angles) of a point on said Line 2, distant 488.8 feet southeasterly of its point of
termination; thence run southeasterly parallel with said Line 2 for 300 feet and there
terminating;

also a right to use the following described strip for highway purposes, which right shall cease
dn December 31, 1983, or on such earlier date upon which it is determined that it is no longer
eeded for highway purposes:
A strip being that part of Tract A hereinbefore described, adjoining and northerly of the above
described strip, which lies southerly of the following described line: From a point on Line
2 described above, distant 888.8 feet southeasterly of its point of termination, run
northeasterly at right angles to said Line 2 for 275 feet to the point of beginning of the line
to be described; thence run northwesterly to a point distant 330 feet northeasterly (measured
at right angles) of a point on said Line 2, distant 788.8 feet southeasterly of its point of
termination; thence run westerly parallel with said Line 2 for 30 feet (measured along said
Line 2); thence run westerly to a point, distant 275 feet northeasterly (measured at right
angles) of a point on said line 2, distant 488.8 feet southeasterly of its point of termination
and there terminating.
PARCEL THREE
That part of Tract A described below:
Tract A. That part of the Northwest Quarter of the Southeast Quarter of Section 36, Township
1118 North, Range 22 West, Hennepin County, Minnesota, described as follows: Commencing at the
intersection of the east line of the west 341 feet of said Northwest Quarter of the Southeast
Quarter and the center line of County Road No. 6 as it existed on December 1, 1949; thence north
parallel with the west line of said Northwest Quarter of the Southeast Quarter a distance of
60 feet; thence west at right angles to the last mentioned line a distance of 130 feet; thence

f 337.1 feet, more or less, to the center of said county road; thence easterly along the
center line of said county road to the point of beginning;
which lies northerly of the northeasterly right of way line of Trunk Highway No. 55 as now

Line 1. From a point on Line 2 described below, distant 1063.8 feet southeasterly of its point
of termination, run northeasterly at right angles to said Line 2 to an intersection with the
northeasterly right of way line of said Trunk Highway No. 55, which is the point of beginning
of Line 1 to be described; thence run northwesterly to a point distant 205 feet northeasterly
(measured at right angles) of a point on said Line 2, distant 928.8 feet southeasterly of its
point of termination; thence run northerly to a point distant 275 feet northeasterly (measured
at right angles) of a point on said Line 2, distant 888.8 feet southeasterly of its point of
termination; thence run northwesterly parallel with said Line 2 for 100 feet and there terminating

south of the center of said Section 36, run southeasterly at an angle of 79 degrees 47 minutes
00 seconds from said north and south quarter line (measured from south to east) for 830.8 feet
to the point of beginning of Line 2 to be described; thence run northwesterly on the last
described course for 100 feet to tangent spiral point; thence deflect to the right on a spiral
curve of decreasing radius (spiral angle 1 degree 07 minutes 30 seconds) for 150 feet to spiral
curve point; thence deflect to the right on a 1 degree 30 minute 00 second curve (delta angle 20
degrees 17 minutes 00 seconds) for 1352.2 feet to curve spiral point and there terminating.

feet south of the center of said Section 36, run southeasterly at an angle of 79 degrees
47 minutes 00 seconds from said north and south quarter line (measured from south to east)
for 830.8 feet to the point of beginning of Line 2 to be described; thence run northwester
on the last described course for 100 feet to tangent spiral point; thence deflect to the
right on a spiral curve of decreasing radius (spiral angle 1 degree 07 minutes 30 seconds)
for 150 feet to spiral curve point; thence deflect to the right on a 1 degree 30 minute
00 second curve (delta angle 20 degrees 17 minutes 00 seconds) for 1352.2 feet to curve
spiral point and there terminating;
also a right to use the following described strip for highway purposes, which right shall

run northeasterly at right angles to said Line 2 for 275 feet to the point of beginning
of the line to be described; thence run easterly to a point distant 330 feet northeasterly
(measured at right angles) of a point on said Line 2, distant 758.8 feet southeasterly of
its point of termination and there terminating.
2. PARCEL TWO

Tract A. That part of the Northwest Quarter of the Southeast Quarter of Section 36, Township
118 North, Range 22 West, Hennepin County, Minnesota, described as follows: Commencing at the
northwest corner of said Northwest Ouarter of the Southeast Ouarter; thence east along the
north line of said Southeast Quarter 341 feet; thence south along a line run parallel with the
west line of said Southeast Quarter to a point 360 feet north of the center line of County Roa
No. 6 as it existed on December 1, 1949, said distance to be measured along the southerly
extension of the last described line; thence west at right angles to the last described line,
a distance of 130 feet; thence south and parallel to the west line of said Southeast quarter a
distance of 337.1 feet, more or less, to the center line of said County Road No. 6; thence
northwesterly along said center line to its intersection with the west line of said Southeast
Quarter; thence north along the west line of said Southeast Quarter to the point of beginning;
which lies northerly of the northeasterly right of way line of Trunk Highway No. 55 as now
located and established and southerly of Line 1 described below:
Line 1. From a point on Line 2 described below, distant 928.8

record in the office of the County Recorder in and for Hennepin County, Minnesota; excepting ther
from that part lying northeasterly of a line run parallel with and distant 35 feet southwesterly
of the following described line: From a point on the north and south quarter line of Section 36,
Township 118 North, Range 22 West, distant 622 feet south of the center of said Section 36, run
southeasterly at an angle of 79 degrees 47 minutes 00 seconds from said north and south quarter
line (measured from south to east) for 1656.6 feet; thence deflect to the right at an angle of
90 degrees 00 minutes 00 seconds for 83 feet to the point of beginning of the line to be
described; thence deflect to the right at an angle of 91 degrees 32 minutes 12 seconds for 1262
feet; thence deflect to the left on a 6 degree 00 minute 00 second curve (delta angle 9 degrees
56 minutes 50 seconds) for 165.79 feet; thence deflect to the right on a 20 degree 00 minute
00 second curve (delta angle 32 degrees 00 minutes 40 seconds) for 160.06 feet; thence deflect
to the left on a 6 degree 00 minute 00 second curve (delta angle 9 degrees 39 minutes 15 seconds
for 160.9 feet and there terminating; the title thereto being registered as evidenced by Certi-
ficate of Title No. 504845;
which lies northerly of a line run parallel with and distant 120 feet northerly of the south
line of said Lot 1; and all of Tract B described below:
Tract B. The east 60 feet of Lot 4, Block 1, Ivanhoe Moods, according to the plat thereof on
file and of record in the office of the County Recorder in and for Hennepin County, Minnesota,
as measured at right angle to and parallel with the east line of said Lot 4; the title thereto
being registered as evidenced by Certificate of Title No. 589777.
also a right to use the following described strips for highway purposes, which right shall cease
on December 31, 1983, or on such earlier date upon which it is determined that it is no longer
eded for highway purposes:
strip being that part of Tract A hereinbefore described, adjoining and southerly of the above
described strip, which lies northerly with a line run parallel with and distant 110 feet
northerly of the south line of said Lot 1;
A strip being that part of Tract A hereinbefore described, adjoining and southerly of the last
above described strip, which lies westerly of the following described line: Beginning at the
point of intersection of a line run parallel with and distant 110 feet northerly of the south
line of said Lot 1, with a line run parallel with and distant 10 feet easterly of the west line
of said Lot 1; thence run southerly on said 10 foot parallel line to its intersection with the
Oasterly extension of the south line of Lot 4, Block 1, Ivanhoe Woods; thence run westerly to
the southeast corner of said Lot 4 and there terminating.
5. PARCEL FIVE
All of Tract A described below:
Tract A. Lot 4, Block 1, Ivanhoe Woods, according to the plat thereof
on file and of record in the office of the County Recorder in
and for Hennepin County, Minnesota; except the east 60 feet
thereof, as measured at a right angle to and parallel with the
east line of said Lot 4; the title thereto being registered
as evidenced by Certificate of Title No. 589779.
The motion for the adoption of the foregoing Resolution was duly seconded
by Counci;lmember Threinen , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Hoyt,
Moan.Schneider and Threinen

Whereupon the Resolution was declared duly passed and adopted.
