The following members were pres—ent a or Davenport, Councilmemb r The following members were absent: none Councilmember Hoyt introduced the following Resolution and moved its adoption: RESOLUTION NO. 82-55 APPROVING RPUD PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT FOR ROBERT MIDDLEMIST FOR "MERRY MIDDLEMIST ADDITION" LOCATED AT PILGRIM LANE AND 31ST AVENUE NORTH (81055) WHEREAS, Robert Middlemist has requested approval of an RPUD Preliminary Plan/ Plat and Conditional Use Permit for twenty-two single family detached dwellings on ten (10) acres located at Pilgrim Lane and 31st Avenue North, and; WHEREAS, the Council has classified the development as an RPUD pursuant to zoning ordinance variance standards in Section 9 specifically because the parcel is an exception abutting a larger development designed under similar conditions to the RPUD standards and the parcel to the south was developed as an SUP, and; WHEREAS, the Planning Commission has considered the request following a duly . called Public Hearing and has recommended approval; NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve an RPUD Preliminary Plan/Plat and Conditional Use Permit for Robert Middlemist for "Merry Middlemist Addition" located at Pilgrim Lane and 31st Avenue North subject to the following conditions: 1. Compliance with the Engineer's Memorandum. 2. Park Dedication be fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 3. Removal of dead or dying trees from the property at the owner's expense. 4. Street names and numbers to comply with the City's Street Naming Policy. 5. No building permits shall be issued until municipal sewer and water are physically available to the site. 6. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 7. That a temporary cul-de-sac be provided at the eastern boundary for 31st Avenue North. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Threinen , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Coouncilmembers Hoyt_ Moen_ Schneider and Threinen The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
