HomeMy WebLinkAboutCity Council Resolution 1981-817r suant to due call and notice thereof, a; regular meeting of the City Council the City of Plymouth, Minnesota, was held on a ar7th day of December B- The following members were present: Mayor Davenport, Counci mem ers Hui, ell Schneider and Threinen following members were absent: none *t* Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 81- 817 DENYING VARIANCE REQUEST FOR GARY IRENE FOR LAND IN SECTION 8 EAST OF PEONY LANE WEST OF THE PLYMOUTH GUN CLUB AND NORTH OF THE SOO LINE RAILROAD TRACKS (79039) WHEREAS, Gary Irene has requested approval of variance from Section 500.43 of the City Code and from City Council Policy Resolution No. 75-664 to permit issuance of building permits on four parcels which are not served by municipal utilities and which do not abut a City street; and, WHEREAS, the Planning Commission has reviewed the request and has recommended denial; and, WHEREAS, the City Council considered the matter on September 22, 1980, and deferred final action with direction to the petitioner for revisions to the petition; and, WHEREAS, the petitioner has not responded to the Council direction or to correspondence and inqueries from the administrative staff regarding the status of the petition; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the variance request of Gary Irene to permit construction of four single family residential dwellings on parcels in Section 8 east of Peony Lane, west of the Plymouth Gun Club and north of the Soo Line Railroad tracks for the following reasons: 1. Petitioner has not established in accordance with the Policy regulating urban development that divergence from the policy will not cause an unreasonable burden upon the City in pro- viding services and utilities or cause a deleterious impact upon the natural environment, as evidenced by the objection to the construction of a private rural road per City standards. 2. Similarly, the variance from the City Code is not in order since the parcels do not abut a public street and since the petitioner is not prepared to provide an equivalent road. The motion for adoption of the foregoing Resolution was duly seconced by 1 Councilmember Threinen and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Hoyt, Neils, Schneider and Threinen The following voted against or abstained: none Whereupon the Resolution was declared duly passea ind s opte .
