HomeMy WebLinkAboutCity Council Resolution 1981-797Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth,nesota was held on the ' 23rd day of November , 19_aL. The following members were present: Mayor Davenport, Councilmembers Hoyt, Neils. Schneider and Threinen . The following members were absent: none CRuncilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 81-797 REQUEST FOR PAYMENT NO. 14 AND FINAL VICKSBURG LANE/NEW COUNTY ROAD 9 IMPROVEMENTS PROJECT NO. 853/911 WHEREAS, the City of Plymouth as owner and Progressive Contractors, Inc. as contractor have entered into an agreement for the Vicksburg Lane/New County Road 9 Improvements, said agreement being dated June ,6, 1979; and WHEREAS, the engineer has certified his acceptance of the work and his approval of the final request for payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $1,012,259.00, fiv,: change orders were approved in the amount of $219,481.97 and the value of the work completed and certified to date is $1,201,907.13. 2. That the work performed by the contractor for Project No. 853/911, Contract II, and certified to the Council by the engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and corrections of faulty work after final payment. 3. Request for Payment No. 14 and final in the amount of $40,542.26 to Progressive Contractors, Inc. for Project No. 853/911, Contract II, is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The mot'on for the adoption of the foregoing Resolution was duly seconded by Coupcil gr Hoyt , and upon vote being taken thereon, the following voted in favor ereo : Mayor Davenport, Councilmembers Hoyt.
