OF PLYMOUTH Pursuant to duecalland notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota was held on the 23rd day Of November , 1. The following members were present: Mayor Davenort Councilmembers Hot Neils Schneider and Threinen . The following members were absent: none ♦f"R R1Ir* ty Councilmember Hoyt introduced the following Resolution and moved its adoption: RESOLUTION NO. 81- 796 REQUEST FOR PAYMENT NO. 8 AND FINAL 1980 STREET IMPROVEMENT PROJECT WHEREAS, the City of Plymouth as owner and Hardrives, Inc. as contractor have entered into an agreement for the improvement of the Medina Road area, said agreement being dated April 1, 1980; WHEREAS, the engineer has certified his acceptance of the work and his approval of the final request for payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $997,972.85, three change orders were approved in the amount of $62,303.00, and the value of the work completed and certified to date is $1,106,258.16. 2. That the work performed by the contractor for the 1980 Street Improvement Project and certified to the Council by the engineer as acceptabel be and the same is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and corrections of faulty work after final payment. 3. Request for Payment No. 8 and final in the amount of $81,981.96 to Hardrives, Inc. for the 1980 Street Improvement Project is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted in favor ereo ; Mayor Davenport, Councilmembers Hoyt, Neils, Schneider and Threinen The' -following voted against orabstained: none Whereupon the Resolution was declared duly passed and adopted.
