The following members were present :Mayor Davenport, Councilmembers Hot Neils Schneider and Threinen The oow ng members were absent: none Councilmember Hoyt introduced the following Resolution and moved is a option: RESOLUTION NO. 81-764 APPROVING REVISED CONCEPT PLAN AND PRELIMINARY PLAT FOR HANS HAGEN HOMES FOR "AMHURST 3RD ADDITION" RPUD 79-2 (79046) WHEREAS, Hans Hagen Homes has requested approval of a revised concept plan and preliminary plat from forty-four quadraminium units and eleven single family lots to fifty-eight duplex units for an increase in the total number of units by three located west of Vicksburg Lane and north of Turtle Lake; and, WHEREAS, the Planning Commission has considered the request following a duly called Public Hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve a revised concept plan and preliminary plat from forty-four quadraminium units and eleven single family lots to fifty-eight duplex units, for an increase in the total number of units by three, located west of Vicksburg Lane and north of Turtle Lake subject to the following conditions: 1. Compliance with the Engineer's Memorandum. 2. Homeowner Association Bylaws and Covenants be approved by the City Attorney and reflect the responsibility for the open space and traffic island delineators. 3. Park Dedication fees have been satisfied for this development as set forth in the Development Contract for "Amhurst Second Addition". 4. The final plat submission to include demonstration of compliance with the Ordinance Transition requirements for attached housing in LA -1 (low density residential) areas. 5. Removal of all dead or dying trees from the property at the owner's expense. 6. No building permit shall be issued until municipal sewer and water are physically available to the sites. 7. Compliance with City Council Resolution No. 79-80 regarding minimum floor elevations for new structures in the Subdivisions or on sites adjacent to or containing any open storm water drainage facility.
