RESOLUTION NO. 81- 763
DIRECTING THE CITY CLERK WITH RESPECT TO FILING OF RESOLUTION 81-762
WHEREAS, the City Council of the City of Plymouth has authorized the vacation
of a portion of the utility and drainage easement on Lot 3, Block 1, Cimarron
Ponds 2nd Addition;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That the City Clerk is directed not to file the resolution vacating
the aforedescribed utility and drainage easement until such time as
the following conditions occur:
a. An encumbrance to run with the land is filed with the County
Recorder to the effect that any unusual or extraordinary con-
struction methods necessary for repair or maintenance of the
storm sewer are the responsibility of the property owner and
will be recovered by either direct payment or assessment against
the property.
b. The city will be held harmless from any damage to the structure
associated with any maintenance or repair activity of the storm
sewer line and/or deterioration of that line.
