CITY OF PLYMOUTH'
Pursuant to due call and notice thereof, a regular meeting of
the City Council of the City of Plymouth, Minnesota was held on the
19 81. The following 2nd day of November g members were
present: `Mayor Davenport. Councilmembers Neils Schneider and Threinen
The following members were absent: Councilmember Hoyt
Councilmember Neils introduced the following Resolution and
moved its a option:
RESOLUTION NO. 81-759
DIRECTING THE CITY CLERK WITH RESPECT TO THE FILING OF RESOLUTION NO. 81-758
WHEREAS, the City Council of the City of Plymouth has authorized the vacation of
a portion of a street easement west of Fernbrook Lane and south of 27th Avenue;
and
WHEREAS, the property owners adjacent to either side of the easement require access
to Fernbrook Lane;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That the City Clerk is directed to not file the resolution vacating
the aforedescribed street easement until such time as the following
condition occurs:
a. A valid, recordable private driveway agreement over the
aforedescribed public easement in a form acceptable to the
City Attorney is provided the City Attorney for filing with
the appropriate County officials.
The motion for the adoption of the foregoing Resolution was duly seconded by
Counci m m er Threinen , and upon vote being ,taken thereon, the
following voted in favor thereor, Mayor Davenport. Councilmembers Neils,
Schneider and Threinen
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
