moved its adoption:
RESOLUTION NO. 81-739 °
REQUEST FOR PAYMENT NO. 11 AND FINAL
VICKSBURG LANE IMPROVEMENTS
PROJECT NO. 801
WHEREAS, the City of Plymouth as owner and Jerome Begin Contracting Co. as
contractor have entered into an agreement for the Vicksburg Lane Improvements,
said agreement being dated September 4, 1979; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment;
NOW. THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount was $605,509.40, two change orders
zn the amount of $38,650.05 were approved, arbitration award in the
amount of $76,300.00, final settlement for clean-up in the amount of
$4,500.00, and the value of the work to date is $772,935.99.
2. That the work performed by the contractor for Project No. 801 and
certified to the Council by the engineer as acceptable be and the
same is hereby released from the contract except as to the conditions
of the performance bond, any and all legal rights of the owner,
required guarantees and corrections of faulty work after final payment.
3. Request for Payment No. 11 and Final in the amount of $42,805.11 to
Jerome Begin Contracting Co. for Project 801 is hereby approved and
the city Finance Director is hereby authorized and directed to pay the
same forthwith.
