Pursuant to due call and notice thereof, a regylar meeting of the City
Council of the City of Plymouth, Minnesota, was held —on --We e 19th day of

Councilmember Schneider introduced the following Resolution and moved
is adoption:
RESOLUTION NO. 81- 727
APPROVING SITE PLAN AND VARIANCE FOR RYAN CONSTRUCTION COMPANY FOR BURNET
REALTY LOCATED SOUTHEAST OF FERNBROOK LANE AND CHESHIRE LANE (81047)
WHEREAS, Ryan Construction Company has requested approval of a site plan
and variance for Burnet Realty located southeast of Fernbrook Lane and
Cheshire Lane; and,
WHEREAS, the Planning Commission has reviewed said request and recommends
its approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of
10 Ryan Construction Company for site plan and variance approval of Burnet
Realty to be located southeast of Fernbrook Lane and Cheshire Lane subject
to the following conditions:
1. Compliance with the Engineer's Memorandum.
2. Payment of Park Dedication fees -in -lieu of dedication in accordance
with the Dedication Policy in effect at the time of building permit
issuance.
3. All waste and waste containers shall be stored within the structure
per submitted plans to be approved by the Building Official, and
no outside sotrage is perm'tted.
4. Submission of required financial guarantee for completion of site
improvements termed for 24 -months.
5. Signange shall be installed per approved plan.
6. The site area not otherwise improved shall be maintained and
shall be free of noxious weeds.
7. The existing advertising sign shall be removed at the developer's
expense prior to occupancy of the building.

8. The building shall be constructed with an auto-aatic sprinkler
system that complies with N.F.P.A. Pamphlet No. 13 in satisfaction
of City Code Fire Protection requirements relative to fire lane
variance.
9. Approval for two variances for 5 feet from the minimum parking
setback requirements.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilmember Hoyt and upon vote being taken thereon, the
following voted in favor thereof: Acting Mayor Neils, Councilmembers
The following voted against or abstained: Councilmember Threinen
Whereupon the Resolution was declared duly passed and adopted.
