The following members were present:Mayor Davenport, Councilmembers Hoyt, Neils, Schneider and Threinen The following members were absent: none w#w :,r,► ,r,t,t Councilmember Hoyt _ introduced the following Resolution and moved—i tsadoption : RESOLUTION NO. 81-693 REQUEST FOR PAYMENT NO. 5 AND FINAL CRITERION M.P.U.D. UTILITIES PROJECT 925 WHEREAS, the City of Plymouth as owner and Northdale Construction Co., Inc. as contractor, have entered into an agreement for the Criterion M.P.U.D. Utilities, said agreement being dated July 31, 1980; and WHEREAS, the engineer has certified his acceptance of the work and his approval of the final request for payment; NOW, THREREFORI, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $551,839.80, two change orders in the amount of $30,027.49 were approved, and the value of the work to date is $585,397.67. 2. That the work performed by the contractor for Project No. 925 and certified to the Council by the engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and corrections of faulty work after final payment. 3. Request for Payment No. 5 and Final in the amount of $4,101.32 to Northdale Construction Co., Inc. for Project 925 is hereby approved and the city finance director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Threinen , and upon vote being taken thereon, the following voted n avor thereof: _Mayor Davenport, Councilmembers Hoyt, Neil] .
