HomeMy WebLinkAboutCity Council Resolution 1981-691CITY OF PLYMOUTH Pursuant to due call and notice thereof, a reaular meetino of the City Council of the City of Plymouth, Minnesota was he on the 5th day of October , 19_U. The following members were present: Mayor Davenport. Councilmembers Hoyt. Neils. Schneider and Threinen The following members were absent:. none qilc member Hoyt introduced the following Resolution and move its adoption: RESOLUTION NO. 81- 691 REQUEST FOR PAYMENT NO. 1 AND FINAL 1981 SEAL COAT PROGRAM WHEREAS, the City of Plymouth as Owner and Allied Blacktop, Inc., Minneapolis, Minnesota have entered into an agreement for the seal coating of certain streets, said agreement being dated August 5, 1981; WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final request for payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $167,651.12 and the value of the work completed to date is $175,386.94. 2. That the work performed by the Contractor for the 1981 Seal Coating Program and certified to the Council by the Engineer as acceptable be and the same is hereby accepted as of October 5, 1981. The Contractor is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the Owner, required guarantees and Correction of Faulty Work after Final Payment. 3. Request for Payment No. 1 and Final in the amount of $175,386.94 to Allied Blacktop, Inc. for improvement is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith from fund 101-172-810. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Threinen , and upon vote being taken thereon, the following vo e n favor ereo : Mayor Davenport, Councilmembers Hoyt, Neils Schneider and Threinen The following vote against orabstained: none — Whereupon the Resolution was declared duly passe Tn-d adopted.
