HomeMy WebLinkAboutCity Council Resolution 1981-679CITY OF PLYHUUIH Pursuant to due call and notice thereof, a re ular meeting of the City Council of the City of Plymouth, Minnesota, was held on the- 5th day of October , 19 81. The following members were present ayor avenport, , pocilmgmbers Hot Neils, Schneider and Threinen following members were absent: none CoWpci-inamber Hoyt introduced the following Resolution and moved its adoption: RESOLUTION NO. 81-679 APPROVING ASSESSMENT COMMITTEE REPORT LEVYING ASSESSMENTS FOR UNITED HARDWARE -PROJECT 904 WHEREAS, the City Council of the City of Plymouth has by Resolution Nos. 81-677 and 81-678 levied special assessments for public improvements including the construction of 49th Avenue North, and WHEREAS, included in said special assessment roll is a special assessment levied against United Hardware Company for the construction of said 49th Avenue North including curb and gutter, and WHEREAS, prior to and at the time of the public assessment hearing to con- sider said assessment roll and the special assessments levied against United Hardware Company, representatives of said United Hardware Company did raise objections to the proposed assessment on the grounds that there was no special benefit by the construction of said 49th Avenue North to the company, and WHEREAS, the assessment committee of the City Council has met with represen- tatives of United Hardware Company to hear their objections and their argu- ments in support thereof, and WHEREAS, said assessment committee and the City Council have carefully con- sidered said objections and the position of United Hardware Company relative to said special assessments, NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH AS FOLLOWS: I. That with regard to the special assessment levied against United Hardware Company for the construrtion of 49th Avenue North, which public street abuts the property of said company, the Council finds that in addition to a general benefit to the company by virtue of the contruction of 49th Avenue Nor;,h, the following special benefits are deemed to have been received by said company: Resolution # 81-679 Page 2 a. Access is provided by a driveway entrance to and from 49th Avenue into and from the property of United Hardware Company affording said company a more flexible and convenient traffic flow, all as provided for in the site plan for the property approved by the City Council. b. United Hardware Company has been excused from the requirement for the construction of fire lanes around its building by reason of the existence of 49th Avenue on the southern boundary of the company property. c. The water trunk main installed on 49th Avenue North to which United Hardware Company is required to connect satisfies the fire prevention requirements of the City Code. 2. The City Council further finds that an industrial type street on the southern boundary of the property of United Hardware Company serving the company's industrial type uses of its structure justifies the levy of the special assessment for the construction of 49th Avenue North and will prove to be a particular benefit to the company.
