Pursuant to due call and notice thereof, a regular meeting of
the City Council of the City of Plymouth, Minnesota was held on the
5th day of October , 19 81. The following members were
present: MA= DaXenport. CouncilmembersHoyt, Neils, Schneider and Threinen

Councilmember Neils introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-674
AUTHORIZING THE VACATION OF
UTILITY AND DRAINAGE EASEMENTS ON THE COMMON LOT LINE OF
LOTS 3 AND 4, BLOCK 1, BURL OAKS ADDITION
WHEREAS, a petition was recived to vacate utility and drainage easements on the
common lot line of Lots 3 and 4, Block 1, Burl Oaks Addition; and
WHEREAS, a public hearing with respect to said vacation was held on October 5,
1981 in accordance with Minnesota Statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meetigg of October 5, 1981; and
WHEREAS, the Council did hold a public hearing on October 5, 1981 to inform any
and all interested parties relevant to the vacation of utility and drainage
easements on the common lot line of Lots 3 and 5, Block 1, Burl Oaks Addition;
and
WHEREAS, it was determined by the City Council that said easement is not needed
for public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That the following drainage and utility easement be vacated:
Six foot utility easement adjacent to the westerly property line
of Lot 4, Block 1, Burl Oaks, which is the common property line
with Lot 3, Block 1, Burl Oaks;
and
Six foot utlity easement adjacent to the easterly property line of
Lot 3, Block 1, Burl Oaks, which is the common property line with
Lot 4, Block 1, Burl Oaks.

2. That said vacation shall not affect the authority of any person,
corporation, or municipality owning or controlling electric or
telephone poles and lines, gas and sewer lines, or water pipes,
mains and hydrants thereon or thereunder, to continue maintaining
the same or to enter upon such way or portion thereof vacated to
repair, replace, remove or otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilmember Schneider and upon vote being taken thereon, the
0following voted in favor thereof:Mayor Davenport, Councilmembers Hoyt, Neils,
Schneider and Threinen
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
