The following members were present: Actin Ma or Neils Councilmembers Hot Schneider and Threinen The following members were absent: or Davenport rrt• yt,t„ t• Councilmember Hoyt introduced the following Resolution and moved its adoption: RESOLUTION NO. 81-657 REQUEST FOR PAYMENT NO. 9 AND FINAL COMMUNITY PLAYFIELD IMPROVEMENTS, PH. I, SCHEDULE D-4 PROJECT 017 WHEREAS, the City of Plymouth as owner and Hoffman Electric Company as contractor have entered into an agreement for the Community Playfield Improvements, Phase I, Schedule D-4, said agreement being dated June 16, 1980; and WHEREAS, the engineer has certified his acceptance of the work and his approval of the final request for payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $215,295.00, three change orders with a net deduction of $290.30 were approved, and the value of the work to date is $215,004.70. 2. That the work performed by the contractor for Project No. 017, Ph. I, Schedule D-4 and certified to the Council by the engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and corrections of faulty work after final payment. 3. Request for Payment No. 9 and Final in the amount of $9,532.34 to Hoffman Electric Company for Project No. 017, Ph. 1, Schedule D-4 is hereby approved and the city Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Coon ilmember Threinen , and upon vote being taken thereon, the following voted n favor therms: Acting Mayor Neils, Coungilmembers Hoyt.
