The followin members were present-77"Mungayor Neils, ounci mem ers How, Schneider and Threinen The following members were absent: mayor Uavenport •re* Councilmember Hoyt introduced the following Resolution and moved its a ration: RESOLUTION NO. 81-649 ADOPTING ASSESSMENTS PROJECT 022 AMHURST 2ND ADDITION STREETS WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessments for the following improvement: 1. 46th Avenue from Upland Lane to 45th Avenue 2. Terraceview Lane from 46th Avenue to 130 feet, more or less, south of 45th Avenue North 3. 45th Avenue from Terraceview Lane to 45th Avenue 4. Ranchview Lane from 46th Avenue south by the installation of bituminous street with concrete curb and gutter and all necessary appurtenances; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such proposed assessment as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein and each tract of land therein included is hereby found to be benefited by the propesed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 5 years, the first of the installments to be payable on or before the first Monday in January, 1982, and shall bear interest at the rate of 8.38% per annum from the date of the adoption of this Assessment Resolution. To the first installment shall be added interest on the entire assessment from the date of this Resolution until December 31, 1982. To each subsequent install- ment when due shall be added interest for one year on all unpaid installments. Resolution No. 81-649 Page 2 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Finance Director, pay the whole of the assess- ment on such property with interest accrued to the date of payment to the City Finance Director, except that no interest shall be charged if the entire assess- ment is paid within 30 days from the adoption of this Resolution; and he may at any time thereafter pay the City Finance Director the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which such payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Finance Director to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxe . 5. The total cost of the improvement assessed by this Resolution is: Street, curb and gutter $115,576.20 Prepayment 36,800.25 Total $78,775.95 The motion for the adoption of the foregoing Resolution was duly seconded by _ $ina Mevor Ngjls , and upon vote being taken thereon, the following voted in favor thereof: Actipj Mayor Neils, Councilaieabers Hoyt, hr eider and Thrginen The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
