Pursuant to due call and notice thereof, a regular meetinr of
the City Council of the City of Plymouth, M nnesota was e7T on the
21st day of September , 19 81. The following members were
present: A inq Mayor Neils Councilmembers Hoyt. Schneider and Thrginen
The following members were absent: may Davenport
Co n ilmember Hoyt introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 811-628
AUTHORIZING THE VACATION OF
A DRAINAGE AND PONDING EASEMENT IN SOUTH SHORE ESTATES APARTMENTS
WHEREAS, a petition was received to vacate a drainage and ponding easement in
South Shore Estates Apartments; and
WHEREAS, a public hearing with respect to said vacation was held on September 21,
1981 in accordance with Minnesota Statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of September 21, 1981; and
WHEREAS, the Council did hold a public hearing on September 21, 1981 to inform
any and all interested parties relevant to the vacation of a drainage and ponding
easement in South Shore Estates Apartments; and
WHEREAS, it was determined by the City Council that a drainage and ponding ease-
ment in South Shore Estates Apartments is not needed;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That the following drainage and utility easement be vacated:
DESCRIPTION OF PARCEL:
That part of the South 15 acres of the Northwest 1/4 of the Northwest 1/4
of 'Section 36, Township 118, Range 22, Hennepin County, Minnesota
described as follows: Commencing at the northeast corner of Tract A,
Registered Land Survey No. 694; thence northeasterly along the centerline
of South Shore Drive a distance of 268.00 feet to the actual point of
beginning; thence northwesterly at right angles 200.00 feet; thence
southwesterly to a point in the northerly extension of the west line
of said Tract A distance 114.48 feet north from the northwest corner
thereof; thence south to the southwest corner of said Tract A; thence
west to the southwest corner of the south 15 acres of the Northwest 1/4
of the Northwest 1/4; thence north to the northwest corner of said south
15 acres; thence east along the north line thereof to the centerline
of South Shore Drive; thence Southwesterly to the point of beginning;
except the road.

DESCRIPTION OF EASEMENT:
A permanent easement for drainage and ponding purposes over, under, across
and through that portion of the above described parcel described as follows:
Commencing at the Northwest corner of this parcel; thence easterly a
distance of 127.5 feet; thence Southwesterly at a 650 angle for a distance
of 195 feet; thence directly west for a distance of 65.625 feet; thence
northerly along western boundary line of this parcel for a distance of 187.5
feet to the point of beginning. A permanent easement for drainage and
ponding purposes is also granted to any part of the creek bed, which runs
through the western side, which lies below the high water contour elevation
of 890.2.
2. That said vacation shall not affect the authority of any person, corporation,
or municipality owning or controlling electric or telephone poles and lines,
gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder,
to continue maintaining the same or to enter upon such way or portion thereof
vacated to repair, replace, remove or otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilmember Threinen , and upon vote being taken thereon, the
following voted in favor thereof: Acting Mayor Neils, Councilmembers
Hoyt, Neils and Threinen

Whereupon the Resolution was declared duly passed and adopted.
