Pursuant to due call and notice thereof, a spCclaj meeting of the City
10 Council of the City of Plymouth, Minnesota, was held on—the -14th day of

The following members were absent:— none
Coouncilmember Neils introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 81-614
APPROVING PRELIMINARY PLAT/PLAN AND REGARDING REZONING FOR NORMAN JARNES/WESTGLEN
DEVELOPERS FOR "SARATOGA CONDOMINIUMS" LOCATED EASTERLY OF TRENTON LANE, NORTH OF
COUNTY ROAD, AND SOUTH OF FUTURE 45TH AVENUE NORTH (81043)
WHEREAS, Norman Jarnes/Westglen Developers has requested approval of a preliminary
plat/plan and rezoning for a multiresidential development to be known as "Saratoga
Condominiums" consisting of 213 dwelling units in three buildings on approximately
18.27 acres located easterly of Trenton Lane between County Road 9 and future
45th Avenue North; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and has recommended approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the preliminary plat/plan for
Norman Jarnes/Westglen Developers for "Saratoga Condominiums" consisting of 213
dwelling units in three buildings on approximately 18.27 acres easterly of Trenton
Lane between County Road 9 and future 45th Avenue North subject to the following
conditions:
1. Compliance with the City Engineer's Memorandum; deleting Item No.
22a.
2. Removal of all dead or dying treems from the property.at the owner's
expense.
3. No building permit shall be issued until municipal sewer and water
are physically available to the sites.
4. Trail outlots shall be deeded to the City upon filing of final
plat and trail improvements shall be made in accordance with
City Policy.
The balance of the Park Dedication requirements, less any applicable
credits for improvements, shall be fees -in -lieu of dedication paid at
the time of development in accordance with the then current Park
Dedication Policy.

5. Rezoning shall be finalized with filing of the final plat.
6. Street names and numbers to comply with the City Street
Namiing System.
7. No building permits to be issued until the final plat is
filed and recorded with Hennepin County.
8. Location of fire hydrants and fire lanes per City Code.
9. The site plan application shall include a landscape and
buffering plan addressing the transition between this site
and the commercial area to the east.
10. Outlot A shall be incorporated with Outlot B.
11. Tte full right of way for future County Road 9 shall be
dedicated for the entire width of the site with the
final plat.
12. The site plan shall include a specific proposal for locating
and screening trash disposal facilities.
13. Deeding driveway access to the City.
The motion for the adoption of the foregoing Resolution was duly seconded
by der , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Hoyt,
