Council of the City of Plymouth, Minnesota, was held on the 14th day of

Councilmember Threinen introduced the following Resolution and moved

RESOLUTION NO. 81- 610
SETTING CONDITIONS REGARDING APPROVAL OF AND TO BE MET PRIOR TO FILING FINAL PLAT
FOR "PLYMOUTH BUSINESS CENTER" FOR TRAMMEL CROW COMPANY (81044)
WHEREAS, the City Council has approved an MPUD final plan/plat for "Plymouth
Business Center" for Trammel Crow Company on that part of Criterion MPUD 78-1
known as Outlot G, south and east of Annapolis Lane and west of I-494; and ,
WHEREAS, said approval includes revision to the Criterion MPUD previously approved
by the City Council;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following
' conditions relating to the approval and to be met prior to the filing of the
final plat for "Plymouth Business Center" for Trammel Crow Company:
1. Compliance with the City Engineer's Memorandum.
2. Appropriate documents to be submitted for vacation of 25 feet
of the existing trail easement along the east side of the
property.
3. Payment of Park Dedication fees -in -lieu of dedication shall
be paid in accordance with dedication policy in effect at
the time of building permit issuance.
4. No building permit shall be issued until the final plat is
filed and recorded with Hennepin County.
5. Submittal of required utility and drainage easements as approved
by the City Engineer.
6. No loading or unloading areas shall be located on the west side
of the buildings and such areas on the interior of the site
shall be effectively screened from view from the west.
7. Compliance with Section 9 of the Zoning Ordinance regarding
the filing of covenants and other documents governing control and
maintenance of common areas; the final plat shall reference
the MPUD plan.

8. Approval is subject to applicable requirements for this property
as contained in the original and amended Development Contract
for the Criterion MPUD 78-1 (A-814).
9. The final PUD plan shall be revised to reflect front area
setback no less than Ordinance minimum standards for the I-1
District, to be submitted prior to filing of final plat.
10. Appropriate covenants approved by the City Attorney, shall
be filed with the final plat restricting outside storage to only
that allowed by Ordinance and approved plans; and, prr*iibiting
outside waste disposal facilities, except as allowed by Ordinance
and approved plans.
11. A waiver of Assessment Hearing on sewer area charges shall be
executed by all property owners indicated on the final plat
and submitted prior to filing of the final plat.
12. The depth of Lot 1 shall be increased to provide for ordinance
minimum setbacks of the interior lot lines from drive areas.
The motion for the adoption of the foregoing Resolution was duly seconded
