Pursuant to due call and notice thereof, as ecial meeting of
the City Council of the City of Plymouth, M nnta was held on the
8th day of September , 19 81 . The following members

The following members were absent: none
cnuncilmember Hoyt introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-590
REQUEST FOR PAYMENT NO. 11 AND FINAL
FERNBROOK LANE/23RD AVENUr/25TH AVENUE IMPROVEMENTS
PROJECT NO. 702/905/909
WHEREAS, the City of Plymouth as owner and C. S. McCrossan, Inc. as contractor
have entered into an agreement for the Fernbrook Lane/23rd Avenue/26th Avenue
Improvements, said agreement being dated July 23, 1979; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment; .
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $909,952.25, five change orders
in the amount of $190,776.90 were approved, and the value of the work
to date is $1,168,122.68.
2. That the work performed by the contractor for Project No. 702/905/909,
Fernbrook Lane/23rd Avenue/26th Avenue Improvements, and certified to the
Council by the engineer as acceptable be and the same is hereby released
from the contract except as to the conditions of the performance bond,
any and all legal rights of the owner, required guarantees and corrections
of faulty work after final payment.
3. Request for Payment No. 11 and Final in the amount of $20,357.29 to C. S.
McCrossan, Inc. for Project No. 702/905/909, Fernbrook Lane/23rd Avenue/
26th Avenue Improvements is hereby approved and the city finance director
is hereby directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Threinen and upon vote being taken thereon, the
allowing vote n favor thereof. Mayor Davenport. Councilmembers Hoyt. Neils,
UWAigor and Threingn
The following voted against orabstained: n n
Whereupon the Resolution was declared duly passed and adopted.
