Councilmembers Hoyt, Neils, Schneider and Threi The following members were absent: none �** ter* •ir,r Counci I member Hoyt introduced the following Resolution and moved its adoption: RESOLUTION NO. 81-588 REQUEST FOR PAYMENT NO. 2 AND FINAL COMMUNITY PLAYFIELD IMPROVEMENTS, PH. II, SCHEDULE C PROJECT NO. 017 WHEREAS, the City of Plymouth as owner and Barber Construction Co. as contractor have entered into an agreement for the Community Playfield Improvements, Phase II, Schedule C, said agreement being dated December 1, 1980; and nen WHEREAS, the engineer has certified his acceptance of the work and his approval of the final request for payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $49,176.00, no change orders were approved, and the value of the work to date is $49,346.90. 2. That the work performed by the contractor for Project No. 017, Ph. II, Schedule C and certified to the Council by the engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and corrections of faulty work after final payment. 3. Requt.st for Payment No. 2 and Final in the amount of $30,625.35 to Barber Construction Co. for Project No. 017, Ph. II, Schedule C is hereby approved and the city finance director is hereby authorized and directed to pay the same forthwith.
