The following members abers Hoyt, Neils, Schneider and Threinen rs were absent: none -� p 4ncilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 81-584 DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT STREET LIGHTING - CRITERION M.P.U.D. (39 RESIDENTIAL LOTS) WHEREAS, a petition has been received from Zachman Homes requesting installation of ornamental residential street lighting in the Criterion M.P.U.D. Addition; NOW, THEREFORE, BE IT HERESY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. A certain petition requesting the improvement of Criterion M.P.U.D. Addition by the installation of residential ornamental street lighting, filed with the City Council on September 8, 1981, is hereby declared to be signed by the required percentage of owners of property affected thereby. This declaration is made in conformance to Minnesota Statutes Section 420.035. 2. The petition is signed by 100% of the affected property owners and they have waived their rights to public improvement and special assessment hearings. 3. The petition is hereby referred to the City Engineer and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is `easible and as to whether it should best be made as proposed or in conjunction with some other improvement and the estimated cost cF the improvement as recommended. The motion for the adoption of the foregoing Resolution was duly seconded by Coun 'lmember Hoyt and upon vote being taken thereon, the following voted in favor t ergo Mayor Davenport, Councilmembers Hoyt.
