Schneider and Threi nen none eR* Councilmember Neils introduced the following Resolution and moved is tion: RESOLUTION NO. 81-566 APPROVING REVISION TO PLANNED UNIT DEVELOPMENT PLAN AND PRELIMINARY PLAT FOR PLYMOUTH HILLS 3RD ADDITION FOR PLYMOUTH HILLS COMPANY (81032) WHEREAS, Plymouth Hills Company has requested approval of a revision to the approved Planned Unit Development plan (MPUD 78-2) to permit a commercial bank at the northeast corner of Vicksburg Lane and 37th Avenue North, and to the preliminary plat for that property described as Outlot A, Plymouth Hills 2nd Addition; and, WHEREAS, the request has been reviewed by the Planring Commission at a duly called Public Hearing on June 24, 1981 and at a regular meeting on August 11, 1981: and, WHEREAS, the subject property has been reviewed in conjunction with PUD plans and final plat for the Plymouth Hills Addition and the Plymouth Hills 2nd Addition for which Development Contracts have been drawn and executed by the petitioner and the City; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the revision requested by the Plymouth Hills Company to the approved plan for MPUD 78-2 allowing for a bank use at the northeast corner of 37th Avenue North and Vicksburg Lane, and a revised preliminary plat for that property described as Outlot A Plymouth Hills 2nd Addition subject to the foliowing conditions: 1. Compliance with the Engineer's Memorandum. 2. Compliance with applicable conditions of executed Development Contracts for Plymouth Hills Addition and Plymouth Hills 2nd Addition. 3. Private drive access onto 37th Avgnue North shall be finalized with site plan approvals and the access drives shall be reasonably spaced and coordinated with access points for future development on the south side of 37th Avenue North. 4. There shall be no private drive access onto Vicksburg Lane. 5. All existing structures shall be removed at the developer's expense prior to the issuance of building permits. 6. All dead or diseased trees shall be removed from the property at the developer's expense. Resolution N 81-566 I Pap 2 7. The PUD plan shall be revised so that the internal traffic circulation is improved within the development so that ingress and egress patterns are consistent with the circulation plan already approved minimizing the need for multiple curb cuts onto adjacent streets. The revisions shall include a private road, built to City street standards from an access onto 37th.Avenue North to an access onto Plymouth Boulevard. 8. A revised PUD plan reflecting these conditions and directions shall be submitted with the final plat. 9. Approval is for the First National Bank of Wayzata only and site will revert to office use if it is not used by the First National Bank of Wayzata.
