Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota, was held on We 8th day of

Councilmember Neils introduced the following Resolution and moved

RESOLUTION NO. 81-563
APPROVING PRELIMINARY PLAT AND GENERAL DEVELOPMENT PLAN/CONDITIONAL USE SITE PLAN
FOR ROBER MIDDLEMIST 6TH ADDITION AND REGARDING REZONING FOR THE PROPERTY AT
THE NORTHEAST CORNER OF ZACHARY LANE AND COUNTY ROAD 9 (81041)
WHEREAS, Robert Middlemist has requested approval of a preliminary plat,
conditional use permit site plan and variances, and rezoning for the proposed
Robert Middlemist 6th Addition on approximately 10.7 acres at the northeast corner
of Zachary lane and County Road 9 for purposes of developing twenty-six attached
dwelling units (13 buildings); and,
WHEREAS, the Planning Commission has reviewed the request at a duly called
Public Hearing and has recommended approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the raquest of
Robert Middlemist for preliminary plat, and General Development Plan/Conditional
Use Permit site plan and variances for Robert Middlemist 6th Addition at the
northeast corner of Zachary Lane and County Road 9 for development of twenty-six
attached dwelling units in thirteen buildings, subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the
owner's expense.
3. Removal of all existing structures and accessory uses from the
property at the owner's expense.
4. No building setback variances are granted or implied other than
the common property line.
5. No private drive access onto existing County Road 9 or
proposed County Road 9.
6. The final plat shall reflect the consolidation of Jutlot A with
Outlot B into a single outlot for the future Courcy Road 9
right-of-way.
i. Rezoning shall be finalized with the filing of the final plat.
8. No building permits shall be issued until municipal sewer and
water are physically available to the site.

9. Required site improvement Performance Guarantee shall be sub-
mitted prior to issuance of building permits and termed for
24 -months.
10. Payment of Park Dedication fees -in -lieu of dedication in
accordance with the current Park Dedication Policy in effect
at the time of filing the final plat.
11. No building permit shall be issued until the final plat has
been filed and recorded with Hennepin County.
12. Extension of 43rd Avenue North shall be addressed in the final
plat and Development Contract.
13. A revised landscape plan shall be submitted with the final plat
indicating additional berming and landscaping along the north
side of Lot 2, south of the new County Road 9 right-of-way
for purposes of providing additional buffering and noise
abatement.
14. Appropriate homeowner association agreements and restrictive
covenants as approved by the City Attorney shall be filed prior
to issuance of permits.
15. An appropriate barrier to be installed between 43rd Avenue
North and County Road 9 to restrict traffic crossover between
these two streets.
The motion for the adoption of the foregoing Resolution was duly seconded
by Qguncil er Throjign , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Hoyt,
