The following members were present: Mayor Davenport, �. Counci�lm_embers Hoyt, Neils, Schneider and Threinen e+e+� M embers were absent: none two i1mPmhPr SChnPidp r introduced the following Resolution and moved its adoption: RESOLUTION NO. 81- 527 ADOPTING ASSESSMENTS PROJECT 702 23RD AVENUE STREET IMPROVEMENT *w* WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessments for the following improvement: 23rd AVenue from Fernbrook Lane to 700 fMet east of Niagara Lane by the install_,tion of biLaminous street with concrete curb and gutter and all necessary appurtenances; NOW, THEREFORE, BE IT HEREBY RESOLVED B" THE CITY COUNCIL Of THE C1T% OF PLYMOUTH, MINNESOTA: 1. Such proposed assessment, a c3py of wi,ich is attached nereto and made a part hereof, is hereby accepted ana shell constitute the special asse!-Ment against the lands named therein and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the ds5vs s- ment levied aiainst it. 2. Such assessment shall be payable in equal annual installments extending over a period of 5 years, the first of the instj'lments to be payable on or before the first Monday in January, 1482, and shall bear interest at the rate of 8.Or per annum from the date of the a.loption of this Assessment Resolution. To the first installment shall be added interest on the entire assessment from the date of this Resolution until December 31, 1982. To each subsequent installment when due shall be added interest for one year on all unpaid installments. Resolution No. 81-527 Page 2 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Finance Director, pay the whole of the assess- ment on such propercy with interest accrued to the date of payment to the City Finance Director, except that no interestshall be charged if the entire assess- ment is paid within 30 days from the adoption of this Resolution; and he may at any time thereafter pay the City Finance Director the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which such payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Finance Director to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. The total cost of the improvement assessed by this Resolution is: Street, curb and gutter $235,748.63 The motion for the adoption of the foregoing Resolution was duly seconded by Qou r Nails , and upon vote being taken thereon, the following voted n favor thereof: or Davenport, Councilmembers H2yt, Neils- �rhnei der and Threi nen The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
