Councilmember Schneider introduced the following Resolution and moved
is adoption:
RESOLUTION NO. 81- 504
APPROVING A VARIANCE FROM THE SUBDIVISION CODE FOR SOMERSET HOMES, INCORPORATED
TO PERM'T A PROPERTY CONSOLIDATION AND DIVISION OF LOTS 12 AND 13, BLOCK 4,
ELMHURST ADDITION (81038)
WHERFAI), Somerset Homes, Inc., has requested a variance from the Subdivision Code
to allow the consolidation of Lots 12 and 13, Block 4, of the Elmhurst Addition
and division of the iarcel into two new parcels;
WHEREAS, the Planning Commission has reviewed said request and has recommended
approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the variance from the Subdivision
Code for Somerset Homes, Inc., to allow the consolidation of Lots 12 and 13, Block 4,
of the Elmhurst Addition and division of the parcel into two new parcels located at
23rd Avenue North and Kirkwood Lane as follows:

P.I.N. No. 26-118-22-21-0071
Lot 12, Block 4, ELMHURST, according to the recorded plat thereof,
Hennepin County, Minnesota
P.I.N. No. 26-118-22-21-0072
Lot 13, Block 4, ELMHURST, according to the recorded plat thereof,
Hennepin County, Minnesota
To be consolidated and divided into two new parcels as follows:

Those parts of Lots 12 and 13, Block 4, ELMHURST, according to the recorded plat
thereof, Hennepin County, Minnesota lying northwesterly of the following described
line: Commencing at the northeast corner of said Lot 13; thence Southerly along
the easterly line of said Lot, 13 a distance of 53.00 feet to the point of beginning
of the line to be described; thence Southwesterly deflecting to the right 79 degrees
19 minutes a distance of 116.50 feet to the west line of said Lot 12 and said line
there terminating.

PARCEL B
Those parts of Lots 12 and 13, Block 4, ELMHURST, according to the recorded plat
thereof, Hennepin County, Minnesota lying southeasterly of the following described
line: Commencing at the northeast corner of said Lot 13; thence Southerly along
the easterly line of said Lot 13 a distance of 53.00 feet to the point of beginning
of the line to be described; thence Southwesterly deflecting to the right 79 de-
grees 19 minutes a distance of 116.50 feet to the west line of said Lot 12 and said
line there terminating.
FURTHER, that the City Manager be authorized to make the necessary special
assessment corrections based upon City policy when the division is approved by
Hennepin County.
The motion for the adoption of the foregoing Resolution was, duly seconded
by Councilmember Threinen , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Hoyt,
Neils. Schneider and Threinen _
The following voted against or abstained: none _
Whereupon the Resolution was declared duly passed and adopted.
