Purs4ant to due call and notice thereof, a regular meetino of
the City Council of the City of Plymouth, Minnesota was held on the
3rd day of August , 19 81. The following members were
present: Mayor Davenport, Councilm
The following members were absent: Councilm mbers Neils and Threinen
Councilmember Schneider introduced the following Resolution and
moved a option:
RESOLUTION NUJ. 81- 488
REQUEST FOR PAYMENT NO. 8 AND FINAL
PUMP HOUSE NO. 5
PROJECT NO. 812
WHEREAS, the City of Plymouth as owner and A & K Construction Co. as contractor
have entered into an agreement for the improvement of Pump House No. 5, said
agreement being dated May 8, 1979; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment;
NOW, YHEREFORE. BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINN :SOTA:
I. That the original contract amount was $77,889.00, one change order
in the amount of $789.14 was approved, and the value of the work
completed and certified to date is $78,678.14.
2. That the work performed by the contractor for Project No. 812 and
certified to the Council by the engineer as acceptable be and the
smae is hereby released from the contract except as to the conditions
of the performance bond, any and all legal rights of the owner,
required guarantees and corrections of faulty work after final payment.
3. Request for Payment No. 8 and Final in the amount of $2,117.93 to
A & K Construction Co. for Project No. 812 is hereby approved and
the City finance director is hereby authorized and directed to pay
the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Hoyt , and upon vote being taken thereon, the
following vo e n favor ereo : Mayor Davenport, Councilmembers Hovt and
Schnei-der
The following vote against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
