Pursuant to due call and notice thereof, a regular meetino of
theCity Council of the City of Plymouth, Minnesota was held on the
a
day of August , 19 81. The following members were
present: Mayor Davenport, Councilmembers Hoyt and Schneider
The following members were absent: Councilmembers Neils and Threinen
Councilmember Hoyt introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-486
A RESOLUTION AUT14ORIZING EMINENT DOMAIN PROCEEDINGS
MAPLE CREEK ADDITION
WHEREAS, prior to the platting of Maple Creek Addition, it was determined that
land was needed for right-of-way for a trail corridor; and
WHEREAS, the development contract between the developer of Maple Creek Addition,
Northland Mortgage Company, and the City of Plymouth provided for the dedication
of a 30 foot easement over Lot 7, Block 4, 11aple Creek Addition, to the City of
Plymouth to be used for a trail corridor; and
WHEREAS, it has been discovered that subsequent to the execution of the develop-
ment contract, said lot was conveyed before granting an easement to the City of
Plymouth; and
WHEREAS, the new property owner has been unwilling to grant a trail easement; and
WHEREAS, said trail is an integral part of the City's trail system; and
WHEREAS, the City Council finds it necessary, proper and expedient in the interests
of the public health, convenience and general welfare of the citizens of the City
of Plymouth for the City to acquire said easement;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the City Attorney is hereby authorized and directed to commence
condemnation proceedings to acquire an easement over the west 30 feet of Lot 7,
Block 4, Maple Creek Addition for the purpose of construction a tr-jil corridor.
The motion for the adoption of the foregoing Resolution was duly seconded by
ouncilmember Schneider , and upon vote being taken thereon, tele

Whereupon the Resolution was declared duly passed and adopted.
