The following members were R. present: The following mem5ers were 'absent: none Councilmember Hoyt introduced the following Resolution and moved its adoption: RESOLUTION NO. 81-458 DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT STREET LIGHTING - AMHURST IST AND 2ND ADDITIONS WHEREAS, a petition has been received from Hans Hagen Homes requesting installa- tion of ornamental residential street lighting in the Amhurst 1st and 2nd Additions; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. A certain petition requesting the improvement of Amhurst 1st and 2nd Additions by the installation of residential ornamental street lighting, filed with the City Council on July 20, 1981, is hereby declared to be signed by the required percentage of owners of property affected thereby. This declaration is made in conformance to Minnesota Statutes Section 429.035. 2. The petition is signed by 100% of the affected property owners and they have waived their rights to public improvement and special assessment hearings. 3. The petition is hereby referred to the City Engineer and he is instructed to report to the Council with. all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in conjunction with some other improvement and the estimated cost of the improvement as recommended. The motion for the adoption of the foregoing Resolution was duly seconded by and upon vote being taken thereon, the 0 lowing voted n favor ereo : Mayor Davenport, Councilmembers Hovj Schneider and Threinen Whereupon voted against or apstiainea: Resolution was declared dulyl
