HomeMy WebLinkAboutCity Council Resolution 1981-445CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 20th day of July , 1981 . The following memhers were present: Mayor Davenport, Councilmembers Hoyt, Neils, Schneider & Threinen,_- The following members were absent: None Councilmember Threinen introduced the following Resolution and moved its adoption: RESOLUTION NO. 81-445 APPROVING SIDE YARD VARIANCE FOR RONALD 0. GOLTZ FOR PROPERTY LOCATED AT 17615 8TH AVENUE NORTH WHEREAS, Mr. Ronald 0. Goltz, 2008 Independence Avenue North, Golden Valley, Minnesota, has requested a five foot side yard set back variance from the fifteen foot ordinance minimum standard to permit the relocation of an existing dwelling on this property in order to provide for desired deck space on the west end and desired driveway width on the east end of the structure; and, WHEREAS, the request was reviewed by the Board of Zoning Adjustments and Appeals on June 19, 1981, at which time the Board denied the variance request, but did approve an alternate variance allowing for a zero lot line set back for the driveway on the east end of the house subject to concurrence by the neighbor on the adjacent property to the east; and, WHEREAS, the petitioner has appealed the finding of the Board of Zoning Adjustments and Appeals by a letter dated July 2, 1981; NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Mr. Ronald 0. Goltz: for a five foot side yard set back variance on the west side of Lot 5, Block 1, Nolan Addition based on the finding that the request is consistent with the Zoning Ordinance Variance Standards and the fact that the petitioner owns the vacant parcel adjacent to the west of the subject property. FURTHER, a covenant shall be filed on Lot 6, Block 1, Nolan Addition, assuring a minimum sideyard setback of 20 ft. on the east sideto insure a 30 foot separa- tion structure -to -structure; said covenant to approved by the City Attorney. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Schneider , and upon vote being taken thereon, the following voted in favor thereof: ayor Davenport, Councilmembers Hoyt, Neils, Schneider & Threinen The following voted against or abstained: None Whereupon the Resolution was declared duly passed and a opte
