The following members were present: ayor Davenport, ounce mem ers Ho t, Neils, Schneider and Threinen. The following members were ab -sent: None •rt **. ,r*,c Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 81-420 REQUEST FOR PAYMENT NO. 6 AND FINAL AMERICK'S IST ADDITION AND MEDICINE RIDGE ADDITION UTILITIES PROJECT NO. 906 AND 919 WHEREAS, the City of Plymouth as Owner and C. W. Houle, Inc. as Contractor have entered into an agreement for the improvement of Amerik's 1st Addition and Medicine Ridge Addition Utilities, said Agreement being dated August 10, 1979; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the Final Request for Payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $232,414.50, no change orders were approved, and the value of the work completed and certified to date is $232,736.39. 2. That the work performed by the Contractor for Project No. 906 and 919 and certified to the Council by the Engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the Owner, required guarantees and Corrections of Faulty work after final payment. 3. Request for Payment No. 6 and Final in the amount of $500.00 to C. W. Houle, Inc. for Project No. 906 and 919 is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Threinen , and upon vote being taken thereon, the following vo e n favor ereo : Mayor Davenport, Councilmembers Hoyt, Neils Schneider and Threinen e o owing voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
