RESOLUTION NO. 81- 412
RESOLUTION ACCEPTING BIDS
PROJECT 017
ZACHARY PLAYFIELD
WHEREAS, pursuant to an advertisement for bids for the construction of
the Zachary Community Playfield, and
WHEREAS, bids were received, opened and tabulated according to law, and
the following bids as shown on the attached Exhibits A, B, and C were
received complying with the advertisement, and
WHEREAS, the low bid for Schedule E was submitted by Aqua Engineering,
and as Aqua Engineering has failed to complete work on Phase I of
Plymouth's Playfield projects in a timely and workmanlike manner
in accordance with project specifications, and as more fully described
in correspondence between the City's consultant and Aqua Engineering,
Aqua Engineering is therefore disqualified as a responsible bidder,
AND, WHEREAS, it appears that the following are the lowest, responsible
bidders:

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, THAT:
1. The Mayor and City Manager are hereby authorized and directed
to enter into the attached contract with the following in
the name of the City of Plymouth for the construction of
the Zachary Playfield:

and further, that the City Manager is authorized to transfer $93,652.75
from the Park Dedication Central Park Account 205-000-371.01 into the
Construction Fund 951-000-501.00-017 to be used for the construction
of the Zachary Playfield.
