Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth. Minnesota, was a on a 7th day of
Jul . 19 81 . The following members were present:!ayor"Davenport,

Councilmember Neils introduced the following Resolution and moved

RESOLUTION NO. 81-402
APPROVING PRELIMINARY PLAT AND CONDITIONAL USE SITE PLAN AND REGARDING REZONING
OF "PORTER ADDITION" FOR ROBERT AND COLLEEN PORTER AT THE NORTHEAST CORNER
OF FERNBROOK LANE AND COUNTY ROAD 9 (81029)
W4EREAS, Robert and Colleen Porter have requested approval of Preliminary Plat,
Conditional Use Permit Site Plan, and Rezoning for "Porter Addition" consisting
of three two-family dwellings on approximately one acre at the northeast corner
of Fernbrook Lane and County Road 9; and,
WHEREAS, the request has been reviewed by the Planning Commission at a duly
called public hearing and has been recommended for approval;
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the Preliminary Plat and
Conditional Use Site Plan for "Porter Addition" for Robert and Colleen Porter
for the site at the northeast corner of Fernbrook Lane and County Road 9 subject
to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Homeowners Association bylaws shall be reviewed and approved
by the City Attorney.
3. A revised site plan shall reflect minimum 50 foot front yard
setbacks to those units adjacent to Fernbrook Lane as part
of the final plat application.
4. No direct access onto County Road 9.
5. Landscaping plans shall be modified to identify 25% of the
plantings as coniferous species and 15% of the plantings to
be 3 1/2 inches in diameter. All other areas not otherwise
improved shall be sodded. Revised plans shall be submitted with
the final plat.
6. Removal of all dead or dying trees from the property at the
owner's expense.
7. No building permits to be issued until municipal sewer
and water are physically available to the site.
8. Rezoning shall be finalized with filing of the final plat.

9. Payment of park dedication fees -in -lieu of dedication in
accordance with the Dedication Policy in effect at the time
of filing the final plat.
10. No building permits shall be issued until the final plat is
filed and recorded with Hennepin County.
11. Submittal of ordinance required financial guarantee to
assure completion of site improvements, termed for
24 months.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilmember Schneider , and upon vote being taken thereon, the
following voted in favor thereof:_ Mayor Davenport, Councilmembers Neils,
Sr-hnL-Ider ,and Threinen
The following voted against or abstained: none
Whereupon the Resolution was declared duly passe and adopted.
